I have just remembered I have some unpaid parking tickets in NY that I never paid. Will A bench warrant for the petitioner produce a denial of my petition?

No.i have a friend who didnt know that he had a bench warrant way back 2005 in a different state,he was able to get a passport,able to visit his wife 2x and was able to bring his wife here.it was only this year that he dealt with it.when he went to the court,the judge just told him to pay the restitution fee balance that he didnt pay then.

as in your case,better deal with it now so u wont have any problems applying for a job with background investigations.my friend only found out his bench warrant when he applied for a job and that company did a background investigation on him.

Unless you've been convicted of a sex crime against a child, the petitioner's criminal record is not grounds to deny a petition.

Unless you've been convicted of a sex crime against a child, the petitioner's criminal record is not grounds to deny a petition.

No, no sex/ violent crimes against anyone. Just two bench warrants for missed court dates for minor violation offenses in NYC one for drinking a beer at a Mets game and another for sitting on a park bench (at the very entrance of the park) in Washington Square park. I never paid much mind to them because they are like glorified parking tickets. Almost everyone gets some stupid Violation summons in NYC. I called to find about paying them off but the court clerk told me that I have to physically be in court to pay the fines. I live 850 miles away now..... So, unless I need to fix this for my beneficiaries K-1 visa I really do not have the time or money to make a quick trip to Queens/Manhattan to pay B.S. fines.

Hahahaha too true... I don't think I know a single person in either NYC or Long Island that hasn't had one at some point... Stay outta Rockville Center, they'll nab you if you don't take off fast enough when the light turns green :lol:

July 2007 - met Jesse at a beach party held by mutual friends in Long Island, NY

May 2008 - J-1 visa expired, had to move back to Australia

July 2008-September 2008 - lived with Jesse for three months in Staten Island, NY

March 2009 - Jesse comes to Australia for 3 weeks

April 2009 - Engaged!

05/20/09 - I-129F petition mailed in

05/22/09 - NOA1!

05/25/09 - touch

09/09/09 - NOA2!

10/01/09 - due to fiance's illness, we are abandoning pursuit of K-1 at this point. Packet 3 received from consulate but won't be returned.

I doubt you'd have to be present to pay fines?? Unless they said this so you would show up in person and then they could arrest you and then release you after you paid the fines. Bench warrants usually mean arrest. If you're ever going through that state and get stopped for anything, they're going to pull you in. I'd be sending a cheque off to them as soon as possible, or get perhaps a lawyer to get in there and pay those fines off.

Yes, The lady who I talked to at court clerks office said "You must appear in person, not even a lawyer can come in for you. Your bench warrant stays on your record and can only be removed if you come to court"" So, It's gonna be a real pain for me to get up to NYC from Charleston, SC to do this. I wonder if the "open container" was even filed in court..... I was pulled over in Upstate NY right before I moved to the city and had missed the court date for the "Open Container" (about 2 years prior) and the cop mentioned nothing about it. And then when I got my summons for "Trespassing" in Wash Sqr Park I thought for sure they were gonna take me to central booking for the "Open Container" missed court date. But again, nothing just took my license ran it gave me a summons and I was on my way. Neither time I was physically arrested, fingerprinted, or booked. Actually, I never really thought of this too much until now with the petition. I find it a bit ridiculous that now that I can pay the fines (Because I'm not a student anymore) They require me to go there. Honestly, it's nothing more then cops trying to fill quotas. I've actually even worked with law enforcement in NJ after these tickets as an assistant to the NJ park police and they told me that even if cops say they don't have quotas.... they really do. Such #######. Sorry for the vent.

yes,the judge will require her to be present in court.they will not arrest her,will just ask her why she didnt pay the fine and will tell her to pay it that day,either by mail or in person,after paying,she'll be asked to write a letter addressed to the judge together with the proof of full payment.that was what happened to my friend,we were with him when he presented himself to the judge.sending checks to pay the fine or sending a lawyer will not work out.
