Im moving to Texas to get away from Obama :bonk:

Texas is still part of the United States. The wish among the terrorist wing of the GOP to undo that hasn't achieved fruition yet.

ok well since getting away from Obama wont work, it will just help me get closer to Colorado so I can go snow skiing again in Crested Butte :yes:

Yes, we need a representative government and judicial system, but to suggest that people are nominated on the basis of their cultural identity as apposed to some overriding merit for the position is just sillyness.

So you agree that gender and ethnicity are not good criteria for selection.

Perhaps, then, the candidate should be evaluated based upon judicial accumen. Perhaps the candidate's previous decisions should be scrutinized for judicial prudence. Perhaps the 67% refusal rate for her decisions on appeal to the current SCOTUS should be cause for alarm.

It is important to understand that the SCOTUS reviews cases appealed from lower courts on basis of their procedural propriety. The SCOTUS does not look at virgin cases, rather looks at the job lower courts have done in adjudicating, on basis of legal process and procedure. Therefore, a SCOTUS appointee should ideally have a perfect track record of cases appealed to SCOTUS, adjudicated as confirmed. Sodomizer has anything but the ideal, being confirmed in only 1 of 3 cases appealed.

Perhaps this lousy track record is the result of judicial incompetence, or perhaps it is the result of judicial activism. In either case, it makes her unsuitable for appointment. She just doesn't have the ability or willingness to do the job as it is defined. Appointing such a loser to the highest court would undermine the right of judicial appeal for decades to come.

Case in point in Sodomizer's judicial history: a recent ruling in which Sodomizer declared that the 2nd Amendment is not incorporated upon the States, severally. Her decision was based upon Cruishank. Trouble with this is, that Cruishank predates the 14th Amendment, which was specifically written to address the State's abuse of civil liberty by selective denial of certain of the inalienable rights written into the 10 Amendments to the Constitution.

So, her decision sets judicial prudence back more than 100 years, allowing for abuse of civil rights that the Congress specifically prohibited by the adoption of the 14th Amendment by Consitutional Convention (75% majority). Her decision flies in the face of case law established since the adoption of the 14th. Her decision either demonstrates her failure to understand legal and judicial principle, or her unwillingness to recognise it.

This case is being appealed to the SCOTUS, and is already unbased by the finding in Heller of 2006 in which Cruishank is described as "outdated and invalid". Will Sodomizer recuse herself from the hearing of the case (assuming that she is appointed)? I doubt it, as she is a liberal judicial activist. In any case, the decision will be overturned by the same majority that handed down Heller.

The result of the shame of an overturned ruling in her own hand? A complete and utter loss of credibility that can only equal FAIL. She will be a lame duck justice.
