Cancelling K-3, and doing CR-1, HELP!!!! before i do something stupid!

OK , from everyones help here , i have decided to go the CR-1 route. I originally was going for the K-3.

First off let me say , both my i 130 and 129f are approved for K-3.

So, she tells me to cancel the K-3 and to start with the CR-1. I need to write a letter to Vermont SC and state why i want to cancel the 129f, then i need to goto www.travel.state.gov and www.cbp.gov and file separately. I don't want to do something stupid here, please advice, and god bless!

Whats my next step?

(the other thing i thought was funny was she said it wasnt called CR1 it was called C1) :blink:

Timeline

Your I-130 and I-129F will likely be approved on the same day, or so it goes with USCIS. Simply ignore any correspondences regarding your K-3 and follow everything for the I-130 and that should be sufficient.

This is why I tell people to forget the K-3, USCIS has been connecting the two petitions and APPROVING them at the same time, this defeats the original reason the K-3 exists (To allow spouse to enter the USA and WAIT for I-130 approval).

Do not attempt to cancel the K-3, doing so may get the CR-1 canceled too.

Simply follow the NVC guides, and perhaps request electronic document processing at NVC, more than likely you can get the CR-1 case to the consulate before K-3 interview, or you can request K-3 interview to be rescheduled or delay responding to K-3 packet 3 if the consulate sends out a packet 3.

You don't cancel the K3. The K3 process involves filing both the I129F and the I130...

You don't cancel the K3 and start over with the CR1. I think you are confused about the process. You have already filed petitions for a K3 visa and a CR1 visa. You don't need to start a new process. YOU stated that you have only received a letter stating that your I129 was sent to NVC. What I was trying to explain to you previously is that if you want a CR1 visa and only your I129f moves forward to the embassy, you will only be able to apply for a K3. MAKE SURE YOUR I130 MOVES FORWARD AS WELL so that you will have the option of applying for a CR1 visa.

You need to ignore correspondence for the I129F which corresponds to a K3 visa. Since you have only received a letter making you aware of the I129F being forwarded, you need to at some point (maybe in a few weeks) call the service center and NVC and make certain that you I130 petition get sent to NVC.

Just ignore any 129f correspondence and focus only on the 130 petition that will allow you to apply for a CR1 visa.

I hope the process is clearer for you.

With the K3 process the I129f and I130 are linked together. Both petitions have been approved for you. Both petitions should be forwarded to NVC. But you only have a letter stating that the 129f was forwarded. At some point your I130 petiton will be forwarded to NVC as well but you need to make sure this happens.

Please make sure you are clear about the terminology you use if you attempt to write to abandon your i129f. If you say you want to abandon the K3 process you might find yourself abandoning both the 129f and 130 petition (the entire process).

The process can get confusing, maybe it is best that you just focus on making sure the I130 gets to NVC and then the embassy so that you can apply for the CR1.

You don't need to do anything else other than make sure that I130 gets forwarded to NVC so you can later apply for a CR1 visa

It is same as my problem. Im waiting for K3 interview date, but my CR-1 is processing at NVC , and we agreed following CR-1. My husband just paid 70$.

About end of Nov,2009 i will know what day interview for K3, will not i go , right ? and my husband have to email to Embassy and cancel it or how.
