Hi,

I am engaged to a great Japanese guy, we have been dateing for 6 months! He is in the United states to go to college, and he has decided to change colleges to the one that costs 20,000 $ less. The problem is getting a Visa that can keep him here with me in the United States until he can get accepted into Ivy tech school in Indiana For a Spring semester. It is so exspensive to travel to Japan and back, about $1000 one way! We planned on Marrying after he finnished School, He only has 2 years left, but if we have to sooner, it is okay with us and our parents ( he is the best man ive ever had in my life!). Can anyone suggest anything to me about what type of visa we should persue? Thankyou so much!!! :star:(L)

If he is in the US legally as a student, you can marry him now, and do the AOS, no other visa is needed. He will not need to leave the US.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Agreed! Marry him (if you are ready and want to of course, not just for a visa and fear of him leaving) and adjust status.

If you want to wait and go for a fiance visa, be advised he'll have to fly home for the interview anyway.

Right now he is here on a visitors visa because he had given the people at the airport his old I20 form from his other college from last year. So he will have to leave the country, I dont know how to keep him here since hes here on a visitors visa, Any Ideas???

The visitor visa is not a problem as long as he did not enter with the INTENT to get married. Sounds like his intent was other than getting married? Yes? As long as you can show reasonable documentation he entered for other than getting married, you can still marry him now and apply for AOS.

If he came without the intent of staying (and you can prove this with his ties to his home country -- lease, bank accounts, etc), you can get married and adjust status (apply for permanent residency). If this is the case, I would strongly encourage you to do so to avoid a potentially lengthy time apart. It won't matter anymore that he's on a visitor's visa; but I wouldn't recommend waiting until he's overstayed to get married and applying for AOS -- do it asap. You'll need to talk to his school to see how it will affect his enrollment, seeing as he won't be an international student on a visa anymore yet not yet a permanent resident.

Your fiance will be ineligible for a new student visa. In order to get a student visa, one is required to prove that there is intent to return to one's home country. Since that isn't the case with your fiance, he will be denied. Applying for such a visa, when the real intent is to marry, is probably fraud before you even get to the interview.

A fiance visa will allow him to re-enter the U.S. for the purposes of getting married, but tends to take upwards of 8-12 months. He will have to return home for the interview. Many couples on VJ run their luck with visitor's visas and visa waivers during this time apart, but note the possibility of being turned around at POE if you're a frequent visitor and/or cannot prove strong ties to the home country (intent to return).

Regardless of your choices, he's pretty screwed concerning school unless he can remain on the same student visa he was on at his current school.

Good luck. Hope you can legally AOS with a quickie marriage now. It's definitely the best option that I can see for you and your fiance.
