He can try a B2. It wont harm the K1 petition if he's denied, just costs the $$ for filing.

I dont want to start any petition until i know i have picture proof. I would like him to try to get a b2 to get him here to visit and to get as many pictures as we need. If he came here, he could stay for up to 3 months. If I went there, it would have to be about only a week long visit.. so I figure its more worth it if he trys a b2 before me going out there. I just dont know if they would approve a nonimmigrant visa(b2) after knowing he's tried an immigrant visa (k1) ... I thought maybe they'd assume he's trying to stay here permanently on a b2, when in reality he would be going back and we would file for a k1 after he goes back to his country.

If the b2 goes wrong with him, I guess I'm going to have to visit him for a short period of time, and get some pics of us together. If I go that route, I'm undecided whether I should do a k1 or a k3.

And about the security camera, when it usually saves footage (30 days worth of footage) the camera is very clear surprisingly. And it does do a "still" or you can also do a print screen from the keyboard button. I have seen previous pictures taken off the camera when people have stolen from the store. I really dont think anything can be retrieved though since its been 8 months now.

If you are considering the marriage visas, look into CR1. It comes with a green card, saves money and is taking approximately the same time as K3 now.

I'll throw this out to all VJ folks who may have a similar experience to yours. Not trying to stir the pot, just looking flesh out all the answers.

You / he may have a bit of convincing to do with USCIS where he came on a K1, didn't marry, met you during that time, and is now trying to come back in again with a marriage visa.

The fact that things didn't work out after spending time with the former fiance should not be a problem. Isn't that the intention of the 90 days to make sure that the two people really want to ? If he did not overstay the 90 days allowed for K1 there should not be a problem there.

Things that can be red flags in K visa proceedings are meeting through family members. You said that his brother is a good friend. It could be seen by a CO that he is using your relationship to gain a green card. I emphasize the "could"" because I am not implying or inferring anything about your intentions. But that is what the CO's are supposed to do, determine the legitimacy of the relationship.

Again, just offering food for thought so that you can anticipate and address any potential challenges in your journey through the immigration process.

Are you wanting the pictures for the petition or the interview?

When we filed our petition we did not have any pictures together. I just sent in my boarding passes (along with my itinerary) and 2 affidavits from my sisters that they had seen us together. That was it. Inbetween filing the petition and interview I went to visit and we took lots of pics and submitted those (along with other evidence) for the interview.

At the petition stage all you need is proof that you have met within the last 2 years, so his passport stamps and boarding passes are good, primary evidence. Pictures are secondary evidence. Once you send in the petition you can go, visit, take lots of picks and have those handy for the interview.

As for him getting a B2, you can try. Like someone said, all you risk is the $131. Remember though that it is hard for a single male from the Middle East to get a B2, let alone someone who has proven their intent to immigrate here by filing for a K1 (which was approved and he did come).

Not to scare you, but men from the middle east go through a of scrutiny to get a family based visa. The fact that he met you during his previous failed marriage attempt is a huge red flag.

To bolster your chances, I'd say go and visit him before you file the petition. In addition to showing that you're serious about each other, you'll meet his family and see how he is amongst them.
