What can I do? After I overnighted my i751 packet on Tuesday May 26, I just realized that the actual 2 page i751 form got lost in all my copies of evidence and I did not include it in the inch-thick packet I sent. Will they send the whole thing back to me? Will they give me a chance to overnight the form I forgot? Should I send in my copy with the missing i 751 packet? Talk about stress---I have plane tickets to go abroad on June 22 and my huband's conditions expire july 3. What should I do????

They will return the whole package to you, at which time you can insert the form and resend it to them. Don't send the form separately as they will probably not match up the two packages and your actual form would be returned - or you would receive RFEs for missing evidence - or else deny it straight out for lack of evidence. It will only be a few days before you should get your first package back. I am assuming you made a copy of what you submitted, so if worse comes to worse and you haven't received it back before you need to leave, make another copy and submit your copied evidence with the form. Is your husband planning on travelling with you on the 22nd? Will he be back before July 3rd, because if he is travelling out of the country and will not be back before his green card expires you may need to make new plans. He should not be out of the country without the NOA extension letter which you should receive in about a week to ten days after your application is accepted.

First of all, RELAX !.....

Probably following is going to be happened :

As soon as they cash your check (without even checking the completeness of forms), they are going to send NOA which will say 1-year GC extension. Your husband can not enter the US after his GC expiration date without NOA.

Your husband can travel with his passport, expired GC & this NOA together. Instead of showing GC at POE, he is supposed to show NOA too along with the expired GC.

Anyway, when they find out some forms are missing, they will RFE you later. So don't have too long vacation & make sure somebody you trust will be taking care of your mailbox so he/she can contact with you in case of USCIS sends some important documents.

Btw, if you don't respond to a RFE in 45 days your application will be denied & you will be placed onto route of deportation. GOOD LUCK !.....

First of all, DON'T send in the form separately, it will probably not be matched up to your file. Your whole package will probably be returned to you within 7-10 days. As soon as it arrives there, they do a quick look-over to make sure the form and the check are right. I know, because I sent in an expired form with the I-129F and got the package back after 10 days.

If your husband is traveling with you, he will have to make alternate plans, because now with the delay, he won't get the extension letter before June 22. If only you are traveling, you don't need to worry. He can add the I751 form to the returned package and send it in himself. He will anyway need to be in USA to get Biometrics done.

They are going to examine your packet, probably within a few days, so it should not take all the long for it to get back to you. Mail it back ASAP. I suppose that you could prepare a whole new package and mail it out Monday, but that seems like a lot of work and would be a pain if they cashed your check and started processing the other package (though I am pretty sure they don't). If you don't get your NOA prior to your trip, make an infopass appointment and try to get his green card stamped.

Without the form they will likely send the whole package back, check included. Wait until that happens, add the I-751 and resend. Use it as a chance to double check what you originally sent. Good luck!

Probably the foregoing will NOT happen

If they do not know what you are applying since the form is missing in package, they will NOT cash the check and they will return the packet

YMMV
