Never thought the day would come........ But I agree with Justashooter. I would wait longer than 5 minutes, I thinkg 10-15 is more reasonable, and then ask if you are being charged. Most likely, they will give a vague answer or something like "Not Yet". Then you say that you do not wish to talk to them outside the presence of your lawyer. They can separate you from your wife, but not kids during questioning. They do this with suspected domestic violence because in cases where there is legitimate abuse going on, the presence of the abuser in the same room makes it very difficult, if not impossible for the victim to state what really happened. I would definitely complain to the Chief of Police, and possibly go to your local newspaper to see if they would be interested in doing a story. Further, I would file a Pitchess' Motion, to ascertain their personnel files to determine if this is a pattern of behavior or a one off offense. From what you stated, there were clearly no physical signs of domestic violence and your wife denied that there was anything of the sort going on. At that point, their investigation should have been concluded, and you should ask to be charged or for them to leave.

I agree that you should consider talking to the police chief but I suggest talking to him off the record. Policemen catch enough real stuff that they would probably appreciate a break for what is in actuality, doing their job. Too many stories of spousal abuse today to just ignore something.

Now, the other thing I am going to suggest is going to be really difficult.

Bake something. (easy)

Take to your new neighbor and introduce yourselves. (very hard)

Don't talk about the incident just visit. (most difficult)

An A$$hole for a neighbor is a terrible thing--but this person hasn't crossed the A$$hole line, yet. Hopefully he was just concerned and let's face it, would you have wanted him to call the police if someone had broken in and were beating you up?

There might be a silver lining in this situation yet.

years ago..i had 3 cops and a pecker sniffing dog..come to my house..just me and my son lived there..

.stating there was a domestic disturbance called in at my address...we reported, "nope not here" and they wanted to look arounbd to see if i had cold cocked any females...

i knew the pecker sniffing dog and his handler and ask him to call in and make certain it was the right address..he did and the dispatcher had gotten the #s wrong..they left...with the german shepard..racking my nuts one last time with his long hard as a rock snout

I would definitely talk with the chief of police. Start off the record and then amp up if he isn't being helpful. Obviously you don't want to discourage the officers from responding to domestic violence reports (trust me, in our town you are lucky if they show up to a call in 45 minutes. There was a girl in our town who was kidnapped, the father was standing outside, could see her and 45 minutes after the 1st call, went in and after several other 911 calls and lots of physical injuries the police finally showed up). However, the officers need to behave in a more respectful manner. Hope it all gets cleared up!

The police were doing their jobs. You know there may be situation where the abuser is very intelligent, and my use many psychological techniques to quiet down his victim in a domestic disturbance.

I understand how you felt from being an innocent individual. These cops were trained in interrogations, and sometimes an abuser who is very intelligent may continue to do further things to his victim if these cops didn't drill you the way they did.

Whatever you feel, you need to consider that they were trying to prevent any serious disturbance which may lead to murder. But, in your case you felt your rights were violated which is also understandable. Be wise about whatever you want to complain about the cops.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.
