hello everyone, i'm new to this site :) so please forgive me if the answer to this question is found elsewhere. :innocent:

my husband is a polish citizen but he's a resident in the UK. he'll be working in the UK through the whole K-3 application process. will he be processed faster if we say on the I-129F that he chooses to apply for a visa at the american embassy in london? or will it be faster in warsaw?

is it even possible for him to select london? will there be any tricky details that we should be aware, if we choose london? :wacko:

If he is a resident of the UK then it will go through London. Has he been there 6 months?

The K3 visa can only be processed in the country where the marriage took place. If the marriage took place in the U.S. then it will be processed in the beneficiery's (your husbands) country of citizenship.

Look at UK forum, that should give you an idea how quick embassy is in London once your case has been approved, someone from Poland may be able to tell you how quick they are in Warsaw. Not sure if it would be allowed to use Warsaw if he is a resident of the UK but someone else may be able to tell you that.

The K3 visa can only be processed in the country where the marriage took place. If the marriage took place in the U.S. then it will be processed in the beneficiery's (your husbands) country of citizenship.

thanks everyone for all you input. very helpful!

it seems like there are a couple answers out there, though.

we were told in warsaw when we went to get his tourist visa last year, that we could have filed in london. and there was no problem with filing for that tourist visa in warsaw, despite the fact that he had been living and working in the UK for 5 years. and the immigrant lawyer we consulted with briefly last week, they said that we could either file in warsaw or in london. is this what everyone hears as well?

so wondering, if anyone knows (or if it's like common knowledge, and i just don't know it yet.. :blush: ), whether it's faster to process the K-3 visa in london or warsaw?

Not entirely correct. K3 is processed in country of residence when marriage takes place in US. In most cases, (not this one) citizenship and residence are the same country so it's a common misinterpretation. If the marriage took place outside the US, the K3 interview must occur in the country of marriage.

The smart play is to skip the K3 and stick with the CR1 process. K3 is virtually an obsolete visa category these days but if paying hundreds more in fees, going through a second immigration process and waiting a few months after entry to have work authorization is your cup of tea, then by all means, take the K3 route.

Facts are cheap...knowing how to use them is precious...

to make our crazy situation a little more understandable, here're some answers:

we are getting married next week, in the US!! (we pushed everything up from this summer for a polish wedding, after consulting with a second immigration lawyer.)

the first one, in january, said that we could just do the residency application for an adjustment of status after he leaves and returns this summer on his tourist visa. the second, we just spoke to this week to get clarification, said that

1) he might not be able to reenter the country on a tourist visa if they detect our marriage plans/marriage and our plans to adjust his status

2) in the adjustment of status processhis tourist visa entries, in this case, would be considered fraud

3) and therefore, to adjust his status from tourist to temporary resident, we would have to hire an attorney and the process would be very risky

so basically we were told that he should leave and file to re-enter as a spouse on the K-3, and that was the least riskiest way. is that what you guys have heard? or this not so accurate, what we've been advised. :huh::(

and sorry, maybe i made it confusing by saying processing. (sometimes i don't even know what i'm talking about.) i think i meant, the visa interview. so according to what we've been advised to do: we're getting married sooner that planned, he's returning to his old job in the UK, i'm filing all paperwork here in the US (I'm in California), and he's going for his interview in London or Warsaw (we were told he could choose. it just depends what we put on the I-129F, i believe it is, for question number 20. (it says that "acceptance outside the country of your fiance's last residence does not guarantee acceptance for processing by that foreign post." but we were told by the embassy in warsaw and by immigration lawyers here that we shouldn't have a problem choosing either one.)

hope some of this stuff clears up any questions on our lovely, lovely situation :) because it is after all, just about love and staying together.

so after all that rambling and attempt at clarifying, do you guys think we can only apply in the US or in London??? your input is valued with the utmost respect. million thanks!!

There is no choice of station for a K3 visa unless you change residency too. A K3 visa interview is in the country of legal residence in all cases where the marriage takes place in the US.

A CR1 visa, not the K3 would be my recommendation. It will be just as fast, significantly less expensive and far less trouble for you. With a CR1, you actually can choose between interviewing in country of residence and country of citizenship when they are different. The K3 location restrictions only apply to K3.

Be careful with "We were told....". Many are simply told wrong.

this is so amazing. why did the lawyers not tell us about this??? but thank you everyone times a million for telling us about the CR1.

but can i ask some more naive questions? i now know about the basic difference between the two, and i checked out some timelines here. and do my eyes deceive me, or does it look like the CR1 is actually a much shorter process, as of late? timelines for the CR1 looked like 6 to 8 months, where the timelines for the K3 i briefly scoped out were like 12 to 18 months. is that generally the average processing times for the two? if so, anyone know why the CR1 (which gives you residency, work permit and travel capabilities off the bat) shorter than the K3 (which requires adjustment of status).

In short, the procedures changed about two years ago. Regardless of what you read and interpreted, the timeline from filing to visa interiview is virtually the same if you use the Ling Che shortcuts for CR1 that you'll find in the Wiki.

Either the lawyer is simply not up to date or wants the extra legal fees for two separate processes and filing two separate petitions. The first step in either process is exactly the same, so go ahead and file the I-130 while you're learning why not to file an I-129F for spouse.
