Timeline

Okay...I was wondering if anyone knew anything about the effects illegal border crossing and illegally staying in the US for several years would have on the whole fiancé visa process. Does it help at all that he left on his own? let me know. Thanks for your help!

voluntary departure? Did he just go back home by himself? Or was he deported?

Being illegal (without inspection) would prevent the AOS to the USC. He would need a waiver if he is under a ban.

If he left without being caught, he would not be in the system (since he didn't get inspected on arrival).

Where is he now? back in the home country?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Then you might need a waiver, because when he fills out forms down the line, it will ask on previous trips to the US, and with your statement you met him in the US, it may come up in the interview.

You may want to consult a lawyer.

I don't advocate lying, however if there was no record of him being in the US illegally, I would probably have not stated that he was here. You might have shot yourself in the foot.

Also suggest you get a lawyer.

I don't advocate lying, however if there was no record of him being in the US illegally, I would probably have not stated that he was here. You might have shot yourself in the foot.

Maybe she blew her whole leg off.

Sounds like and Uphill battle all the way.

His illegal entry and presence will cause a ban. You may be able to overcome this ban with a waiver. See a lawyer for assistance. Good luck to you.

They will deny the visa but there will be a waiver available.

Well, I hope u didn't SAY he was here illegally on anything you submitted!! :o If so, you definitely need a lawyer, I would think!! :(

However, if you just say you met here and provided some photos, perhaps you can simply cancel the petition, go to mexico and meet him again, then file a new I-129F (?) (omitting any mention of previous meetings in the US!!)

You might want to get some legal consuling first though, as you'll be throwing $455 down the drain :(

Contact Catholic Charities if there is one near you (most likely) and get some guidance.

Note: got an initial interview date in Sept, but decided to put it off so she could extend her vacation here thru end of October

AOS approved YAY! Green Card Received October 4, 2010

USCIS will NOT deny the visa... care to guess why? because the USCIS does NOT issue visas...

In this situation the USCIS will in all likelihood approve the petition.... the consulate will most likely refuse the visa...

Mistake and Risky - Of course

Cheat on Former Wife / Shoplift / Drink and Drive Illegally - No I can't say that I have done those things

I have drink and driven back in my younger days, but then it was legal to drink and drive as long as your were under .10 Blood Alcholol Rate.

it can be 5 to 10 years depending on his case " My step fater got 5years and he had his green card he could have waiting for a court date but after 4months in jail he said he wanted to be self deported* everyone highley advise him to stay it was a miss understanding he should wait for his court date but he got tired of waiting and wanted to see his wife and kids so * He got 5yrs and had his green card now someone who does not i hate to know how long it is but i belive its 10 and lol my step dad 5 yrs are up but he is not coming back to the u.s.a he is still upset about how immgrants are treated i dont blame him "" ** He was in jail for failure to not show up in immagraion apointment, which he swears he had no idea he had thats why he did not go, and i belive him b/c he was crossing mexican and american boarders and working in his name::

12/28/2007-- Married in mexico

02/2/2009- Sent out I-130

02/06/2009-Noa1

04/27/2009-Noa2 Approved :)

05/02/2009-noa2 Hardcopy in the mail :)

05/18/09- Nvc case number and Ds-3032 also paid Aos bill

06/16/2009- paid IV bill

07/20/2009- sent out Aos ( yea I paid everything now im sending it. I was out of town with my hubby for 2months Thank God they let us pay online now only if we could send everything else online lol )

07/30/2009- Sent out DS-230

08/12/2009- Case Complete with NVC

09/01/2009- Visa interview has been scheduled for 10/05/2009. Letter by email.
