some days ago I went to get my SSN, I am on a K1 Visa and the lady said I can't have a SSN without a good reason. I have shown all the documents that says I don't need a work permit to have a SSN issued, but she said she won't do it and to come back only when I get my Work Permit or when I get my status updated. Lets just say I am upset, it will just add more delay after I get my work permit.

the lady at the ssn office is wrong, we got a number for my wife before we were married. it is printed on the card for work only with dhs athorization even though she does not have a work permit. we needed this to open a bank account in her name so we can get her a state id card and she can stop carrying her passport as id. i think you should go back and try again

I agree with the poster above--the woman was wrong. She should know her job!

When you go back, bring a print out from the Social Security website--all the eligibilty requirements are printed there. That should prove to her that you are eligible for a SSN and that you don't really need a reason to apply for a SSN.

i probably think that you are eligible for a SSN since you enter on a K1, the guy from the SSA told us we need to have a EAD before i can get the SSN ince i entered on a K3 visa, but if i entered on K1, it wouldn't be needed.

We definitely got one while my husband was on his K1 - also in Maryland - we went to the office in Columbia - if you aren't too far from there, you should try that office instead...

she told me basically that it was only for food stamps and stuff like that, if I don't need the gov help I don't need that. I gave her the document of eligibility requirement and even with that she refused. I don't know if it's a problem but we were already married when I went there.

oh I forgot, Montreal wrote with a pen on my I-94 " Sep. X9, 2006 Employment Not Auth"

She said she did not liked that line, that just prooves I don't need SSN

Which SSA office did the geniuses tell you this?

Some SSA offices don't seem to know who is eligible for a SSN and who's not. Maybe you need to print out this:

https://s044a90.ssa.gov/apps10/poms.nsf/lnx/0100203500

and hold it under this person's nose?

We were told the same thing as you at the Albuquerque NM office. We were told that if I would of applied for the SSN before we were married with my K1 it would of been no problem but being that we were married I was to wait until I had proof of a green card. I had no EAD at the time either.

A friend of mine in California entered on a K-1 visa, got married 2 days later and then also tried to apply for her SSN, and was refused. She was told that she would have been eligible for a SSN due to the K-1 visa only BEFORE the marriage, and that she'd now have to wait until she received her EAD. With the EAD, they'd give her the SSN.

Apparently there is also a question of how long the K-1 is still valid at the time when you apply for the SSN. If it is expiring in a month or less, they might refuse you as well at the SSA office, even if you aren't married yet. So apparently the best thing is, if you come in on a K-1 visa, to wait for about 14 days (to make sure your name is in the system), then apply for a SSN, and THEN get married :D

There is no question of SSA policy in issuing an SSN to an individual with K-1 status before or after getting married as long as the I-94 has not expired or is within 14 days of expiring.

If anyone tells you different they are wrong.
