Hi again!

Im the guy full of questions lol

My wife made about 40000$ in 2006 and 2007 and we got the tax transcipts to prove it. After that she moved, got another job, and was paid half in cash in 2008. So she can only show about 14000$ for the 2008 on her tax returns. In actuality she made around $22,000 but can't prove it for 2008.

Since January of this year she is now paid all in check and shows enough income. She can provide an employer letter showing how much she makes and some current paystubs if necessary.

My question is, will the low income shown for 2008 disqualify her as a sponsor? Or will they take the average of the past three years, use common sense, see that she definitely makes enough now, etc.?

Any opinions are greatly appreciated!

03-21-09 --> Marriage!

07-13-09 --> Application received by the USCIS

08-17-09 --> Biometrics appointment

09-11-09 --> EAD card received!

10-08-09 --> Interview... Approved!

just because she was paid in "cash" does not technically relieve her responsibility to properly report it and pay the appropriate amount tax on that "income."

The low(er) income for 2008 will not likely disqualify her as a sponsor (or more precisely, cause you guys to need a co-sponsor) - They will look at both her current income (based on pay stubs and in part on the employment letter) and use her other tax returns to show consistency in income.

It's about current income that can be proved. If the 2008 tax return/transcript shows $14K that's the income.

If her employer letter and current pay stubs show an annualized income above the poverty line then you should be ok.

Fill in your timeline and indicate your situation / what type of visa you are working towards. Doing this will help you get better reponses here on VJ.

Well in fact it was a new job, and now she's manager. All other employees are indeed paid about $14000...

Her 2008 income was not that far below the poverty line and by now with her being a manager her present income should be higher. You know, there is a provision if she has a lot of assets to use the value of those assets to offset the shortage in the 2008 income. I can't recall the exact formula but I am sure one of these helpful people know it. It is something like 10 times your yearly shortage or 40 times your monthly shortage, I just can't recall.
