My husband has 3 children living in overseas with their Mother, I have a 21 year old USC son who lives on his own. My husband doesn't have his kids birth certificates, their Mom has them. They aren't coming to live here.. not even planning a visit at this time... (Thanks to their Mom's refusal to even consider such a thing...... )

Do we really need to bring birth certificates for our children? We don't have any together...

The list is a real SHOT GUN BLAST of requested stuff... (like a master list for every possible scenario) so I'm thinking they don't need it unless we were applying for Visa's for them.. and no need for my son's bc because he's a USC...

Any Comments? Advice?

Well it all depends on how nice the IO is. I would list their names on the application as they are required.

List their names on what application?????????? I asked why and if they really need the children's birth certificates at the interview?

In the i-485 form, there's a part that asked for present husband/wife, all sons and daughters ..... so, they're should be listed there. but if u cant really provide the birth cert, just tell the IO the reason and hope that they'd understand.

By the way, who's applying for AOS? I'm thinking it's your husband, right?

Yes it's my husband, and it would be pretty darn strange if my husband was the USC and his children lived overseas and were not citizens and never planned to come here because their Mom won't let them and we need THEIR birth certificates AND my 21 year old USC son lived here, and I was applying for AOS...

Our I-485 was sent in OCTOBER! I'm not trying to fill out a form. I'm not wondering if I should put their names on a form... I'm asking about needing to have MY HUSBANDS' CHILDRENS BIRTH CERTIFICATES with us when we go to the INTERVIEW for his AOS.

As stated in the initial post, we are going to the INTERVIEW.

I can't figure out why this is such a difficult question to get an answer to... :blink:

I think you need children birth certificate otherwise how it will determine and prove children age and parents.

Birth Certificates

May be obtained from the appropriate Public Health Office of the Ministry of Municipal and Rural Affairs having jurisdiction over the locality in which the birth occurred.

My Husband has 3 Prior Children and I have one ( A USC ) we were not asked for this information and I applied for his kids also, but not at the same time as him. It was not requested from us........

We were not asked to, and did not bring, any birth certificates to the AOS interview. However our list of needed documents amounted to my wifes passport and I-94 card...that was ALL. We were never asked to present ANY other documentation at the interview and NO questions were asked concerning our relationship. My wife took an oath to tell the truth, was asked to re-affirm the questions on the I-485 ("Are you a terrorist?" etc) and we were informed she was approved. The only other "question" asked was one while he was shuffling papers around..."How is Gary treating you?" Her answer? "Good, so far, but who knows, tomorrow he may go crazy and kill everyone around". Thank you, Alla. :)

I had the whole stack of evidence and held it on my lap and carried it back out the door 13 minutes after we arrived. OK, that said, personally I would be a bit concerned about not having something they have specifically asked for, regardless of if it is reasonable.

The letter we rec'd with our appointment date and time asked for us to bring every single document that had ever been required for every previous step of our Visa Process... From the I-129 Application Package to the AOS package. There were little boxes next to the various items, but none were checked so I guess they want ALL of them... They also asked that we bring original documents and a copy of each, or they might keep the original...

I"m glad to hear 2 of you in our situation did not get asked for your children's birth certificates... we will have copies, but not the originals... My husband took the originals and translations to his interview in Cairo, and didn't realize he would need them here...So the kids have scanned the documents and emailed them to us, but that's as much as we can do at this point..

I wonder why the are asking for EVERYTHING from us, and so little from others? We have not had a single RFE throughout this process.

I'm self-employed so they are not going to get my pay stubs for the last 2 months! I am a contractor for the Federal Government and I don't even get paid by checks... they require that I accept direct deposit of their payments so I can't even show the ANY evidence of those payments except for the bank statement that shows their deposits.

Oh well, you do what you can and hope for the best... Their idea that every married couple is the same and should have the same way of doing things, and way of living as husband and wife is ludicrous at a minimum and moving towards offensive to some of us who do not live according to American cultural/societal norms simply because we happen to reside in this country. Many of their listed types of "supporting evidence" are against the tenants of our faith... Hope someday the cookie cutter mentality will fade some...

Thanks for the encouraging news about kids birth certificates... Have either of you who have kids/step-kids overseas brought your kids to the USA to visit on tourist visas? We would love to do this someday, but haven't figured out how or IF they would be allowed to come for a short visit... We're thinking the USCIS would ASSUME they were trying to "sneak" into the USA with plans to stay and force them to go through the whole Immigrant Visa process just to come for a month or two... :(

OH GREAT!!! I just read it again and not only do they want birth certificates, they want CUSTODY PAPERS!!!! Good grief! Such papers do not even EXIST for my husband's children... Honestly do they think every other country operates like the USA? Guess they will be finding out this isn't the case.. I'm just sick at the thought of this being a reason to deny us... or put our case on hold... :o

To tell the truth, I was surprised they asked only for my wifes passport and I-94. I even posted questions here and kept getting answers that I "would receive a letter with a long list of items to bring" and I kept responding..."I HAVE the letter and that is all it asks for!" At any rate, I brought every document we ever submitted, the whole damn file PLUS all our evidence of being arried, etc. and they never asked for anything, nothing! I do not even recall them looking at Alla's passport or I-94 but they may have right when we came in and I was trying to organize all my evidence they never looked at.

Be that as it may, most people receive a more extensive list of items to bring. It is really up to the office doing the interview. My suggestion is bring all they ask for if you can, if you cannot, well, what can you do? Hope for the best. I do not see why children not applying for an AOS would be signifcant.
