Her boyfriend Louise great up in the US but was born in Mexico. They met here in the states, fell in love and then he was deported to Mexico. It doestn show as a deportation because it was voluntary, he checked this with the Mexican officials. My daughter went into Mexico to be with him and lived there the past several months. She is back home now, and pregnant. They want to get married. What is the easiest & quickest way for them to marry? Neither have ever been married before and they have no children other than the one she is carrying in her tummy.

Thank you for any advice. We would love to get him here before this baby is born! We have been told she needs to get her birth certificate apossiled and move there and marry him then he could come here within 10 days and then others have said to fiance visa. Please help.

File an I-129F for a fiancee visa, and possibly have to file for a waiver if their is a bar based on the illegal presence in the USA.

OR Travel to Mexico and legally marry, and then file an I-130 for an IMMIGRANT CR-1 visa and again may have to file a waiver for the illegal presence in the USA.

No fast way, for the most part CR-1 and K-Visas have been taking similar times, CR-1 for Mexico tends to take a few months longer.

Note CR-1 allows the immigrant to take a job immediately after entry to the USA allowing to support family, K-Visas need to apply for AOS and EAD and cannot work until they have EAD or green-card which can take 90 days or more to get.

Getting married and getting him here are separate issues unless you mean "get married in the US". In that case, doing it before the child is born is most likely out of the question. He may be facing a ban on entry and/or the need for a waiver. Since he can't come here, any marriage in the next few months will not be in the US.

Every case is different, have you tried contacting the USCIS office directly? It's ok to get people's advice but no case is alike.

The quickest way... hummm, I have to say the regular visa... but with his background, not likely!

If your daughter files for a K1 tomorrow there is great chance her "boyfriend-fiance" could be here before the baby is born.

What you can also do, is get in contact with one of your state representative, see if he can help you with any priority in the case.

I did an I-129F for my husband, (felicidades por tu nieto), who is from mexico, it was easiest, however in ur daughters case, b/c her husband may be facing a ban, you may want to go to this site,.... im a part of this site too, and it for mexican cases ONLY and almost all of the women have faced bans with their husbands or boyfriends and they would deff. be able to help you. good luck and let me know if you have any more questions. feel free to pm me. Mine too. Can you tell us a bit more about his "voluntary deportation"? If he was overstaying in the US and simply went back home to Mexico, then theoretically, the US government should be none the wiser. However, you state that he was actually deported, yet he left volutarily. So, to me, this means that they caught him over staying and he choose to pack up and go home without a fight. Is this right? If this is the case, then most likely he does have a ban or at the very least you will have to fill out a waiver. But as the above states, I'm not sure how Mexican officials could tell him what his status in the US is!?
