Timeline

Hello, My fiancé and I are working on a fiancé visa. My fiancé didn't

meet the minimum poverty guideline for 2008 because he just finished his degree in May 2008. Does anyone know what

assets the government will accept as proof of financial support? In

addition, he has some money in savings. What amount of money would be

needed to makeup a $1500 shortfall in 2008 (he had $12,500 of the

required $14000(100%) for 2008)? Will it be 100% or 125% of proverty guideline?

Unless he is in the military, you'll need to be at 125% of the federal guideline for poverty. I'm not sure what assets could get you around this number. The best thing would be for him to have a job that shows he'll be good in 2009 or for him to find a cosponsor for the visa.

but in Thailand, the us embassy doesn't accept a co-sponsor. We just got appoved from USCIS and still waiting for NOA 2 hard copy to send.

I believe it is 3 times however short he is. I believe 125% of the newest poverty guidelines would be approximately $18,400 for two people.

He would need to have about $17,700 ($5,900 X 3) in the bank. However, that is just to meet the minimum. Often they would want to see his earnings somewhat over that amount. I recommend he have proof of meeting the minimal income requirement for 2009 (employer letter + pay slips).

Thank you for your suggestion.Well... I don't think he have that much in his bank account,will his life insurance help too because he doesn't have any asset? He is working at the university as a full time employee and he is staying at the University apartment. I think his minimal income will meet the requirement for 2009.

You would have to know the cash surrender value of his policy to know if it can be applied to assets. Read through the I-134 instructions for all the asset calculations.

For a K1 Visa the sponsor's I-134 only needs to show 100% of the federal poverty guidelines. However, when you adjust status (with a K-1 visa that is within the 90 day requirement for getting married) you will submit the I-864 Affidvit of Support and then need to meet the 125% of the federal poverty guideline. There you can have an co/substitute/additional sponsor.

Is your fiance's salary now above the 100% level? If so, then he ought to pass the test for the K1. If his income is below the 125% be preparing NOW for another sponsor that does meet the requirements expected at the AOS.

If you use assets, you will have to provide 5 x the difference between the amount of income and the poverty level needed.

it's all spelled out here I-864 FAQ

Most embassies/consulates will use the I-184 standard for the I-134. (Sometimes even requiring 125% for the I-134, not withstanding what the State department level is (100%))

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Quick question about this form Example I-134 . On question 10, under "Date submitted"(visa petition to uscis) do I put the current date? or date I sent in my I-129f to uscis?

I dont think you would need $17k+ in the bank..however in your pay stub YES

TIMELINE

Feb 21 2007-Mar 21 2007 = 1st visit in Manila

Mar 04 2007 = our official anniversary date

Sep 03 2007-Sep 26 2007 = 2nd visit in Manila

May 01 2008-June 04 2008 = 3rd visit in Manila

May 04 2008 = Engaged

July 02 2008 = sent out I-129 F

July 22 2008 = NOA1

July 23 2008 = Check Cashed

Feb 23 2009 = NOA2

Apr 08 2009-May 07 2009 = 4th visit in Manila

Apr 13 2009 = Medical passed

Apr 23 2009 = Interview passed

Actually, my fiance just starts working in Semptember 2008. If he work for whole year, he will make above 125% poverty guideline. He just got his work recommendation letter yesturday from his employer which shows his yearly income above 125%.

How can paystub help for my fiance situation? Sorry, I really don't know what it mean.... How does it work?

Timeline

An employer letter showing his term of employment, postion, and his wages along with the pay stubs (the portion of the paycheck that shows the period earnings along with the YTD (year to date) earnings) will be an important part of the I-134.
