My Fiancee And I meet and engaged last week. However the other day her past petitioners Visa was approved and pending. She had told him to stop the K1, that she wanted out. And he ignored her request. My question is.. If her embassy has her for an interview. How will this effect our request for our K1 Visa? Can she just not accept the the petitioners package for the interview? Do we need to wait for the 4 month expiration for our K1 application? Can she with draw the request for the K1 Visa?

Or does he need to? Or does she need to do anything at all?

Any help here, please

I think only the petitioner can withdraw the petition. Your fiancee can simply ignore any correspondence regarding the petition/interivew. I suggest you wait until the 1st petition has been fully closed before filing.

And when it does come time for YOUR interview: be very very very prepared to answer some extra questions about why she has two petitions for her, much less two petitions for her in such a short period of time!

That will be a HUGE red flag for the embassy in thinking it is only for a GC. I'm not saying it is, I'm just saying be prepared!

While processing, she was talking to you? If she wanted to stop the process I guess she can send letter to cancel the petition. And you file for K1 visa for her. I just hope that what have happened to her and the ex fiance won't happen to you. Goodluck on your journey

I meet and engaged last week How long have you known her? Maybe waiting on the first K-1 to expire may give you more time to get to know her. Why does she want to stop the first K-1? To me, these are red flags. I could be wrong. From what you said, it looked like you just went to see her and got engaged. There is nothing wrong with that, but I think that most have a period of communication, verbally and written before, during, and after you meet.

It's important to understand the terminology. The first petition has been approved but the beneficiary has not yet applied for the VISA with the Embassy.

The I-129f is not the application for the visa itself it is merely the petition that approves the couple so they can move forward and then apply for the visa.

Your fiance (the beneficiary) will need to contact the Embassy and let them know she will not be applying for a visa with the petitioner listed on the first, but does have another petitioner filing for her. There will likely be some scrutinization and some hard questions asked that she will need to prepare herself to answer.

But I think it is much better if you wait for a period of time before filing a petition for her. Get to know her first before doing such things. In I-129F, there's a question "Have you ever filed for this or any other alien fiance(e) or husband/wife before? SInce someone filed for her already, her name will be on the list of USCIS. So she must prepare for possible question such as what happend to the past relationship? Why its so quick blah blah. I think people should avoid such thing so you can get a good record. We don't know what happened to her past relationship but I think she should think a lot of times before having decision, especially this is all about a lifetime committment, not about going to USA and getting GREENCARD.

I don't think the sentence "we met and were engaged last week" implies they met and were engaged within the week. It could very well mean that they met....and last week they were engaged. ;)

Even if they did meet and get engaged all last week, it's not really our place or our job here to judge.

We have been in Communicating with each other for 4 months before we met and engaged during my visit with her. She had realize that she was too hasty in acceptance of her first petitioner. And called it off before she knew me. She had found that she had not truly loved the man and didn't want a visa for the wrong reason. After months of no contact with him. He notified her that it was approved. She again told him no thanks.

Is it best for her to contact her embassy and explain it to them? And The 4 months expiration time.

I'm being told from a lawyer that we don't need to wait. That we can file asap.

Any comments on this?

Filing for the petition is a different process than is filing for the visa. So yes, you can file whenever you like.

Yes, there is a 4 month validity of the approved petition but you will still want to be sure she contacts the Embassy so it leaves nothing to question. She will need to explain that she informed the former petitioner that she did not want to follow through but it was never cancelled.

I agree. She cant be passive about this. It seems that the first man who petitioned her was being stubborn and passive aggressive by ignoring filipina's messages of not being in love with him anymore. So he ignores, and just letz the petition be approved for embassy interview. Maybe he thought pinay would then fall in love with him at the embassy interview :wacko:

So girl, you need to send a formal letter to USCIS, NVC and USEM stating you told him to halt the petition. You abandoned the relationship and he did not respect that. Send in copies of any emails you sent him in previous weeks and months telling him.

I agreed with you.She would definitely get lots of questions. I love USEM. I attended K1 inteview there with my now wife.Our interview was very short and sweet. The staff are very nice. I love the Philippines. People there are so nice and friendly. Good luck.

On paper the visa expires in 4 months of approval. However the embassy automatically extends it.

Best if she can get her ex to cancel it. If not she should call USEM and ask what she can do to cancel on her own.

There "may not" be much problem as her cancelling on her own shows she's not just looking for a green card as she cancelled one chance at getting to the US.

Main thing is for her to be honest if the question comes up why the first was cancelled.

If you want to help. Make multiple trips to be with her. Shows more evidence of a bonafide relationship. Start piling up phone, chat, email, snail mail records also.
