Exactly. From the Customs & Border Patrol Agency website:

Q: What Are the Disadvantages of Using the VWP?

A: If you are admitted to the United States under the VWP, you may not change or extend your non-immigrant status. If your admission is denied, you have no right to administrative or judicial review, except as noted above. Likewise, if you are found to have violated the terms of your admission, you also forfeit the right to contest a removal order and to enter under the VWP ever again. Therefore, before using the VWP, you should carefully consider your options.

just a minor dose of reality. Be happy about your interview but don't be naive. Remember all u got was the interview. Old d was just sending out a word of caution. If I were u I would appreciate it and take it as it is. No need to be defensive.

I agree, just take Old D's reply as a word of warning instead of taking it as an offense.

Well, we are one of those "Hush-Hush" couples who went the VWP-AOS route.

We didn't think it would have gone THAT fast, and also the fact that we live in a remote area might

help a little bit cutting down on the wait...

We have only a month to gather together all the documents they are requesting! Yikes!

But what is a "Hush-Hush" couple?

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

ok i cant copy it from the instructions so i write it down

10.Who is not eligible to adjust status

K.You were admittet to the United States as a Visitor under Visitor Waiver Program,UNLESS you are applying because you are

an immediate relative of a US Citizen ( Spouse,Parents,Widow,Widower,Child under 21 of Age)

So...there is it...if u are merry an US Citizen under VWP u can adjust Status...i dont know what is so hard to understand..or why there is any point to be worried...or do u guys give the advise also on the persons who came with K1????

and the point is why i wrote this is because everybody makes stupid comments about the people who married under VWP.

or make them fear that they can be deported or what ever...we have in the same way to proof that we have an bona fide marriage like everybody else too...no matter if K1 K3 oder other visa

I think some of the concern is "intent"

If you get married two days after entering the US under the VWP, that would be a red flag, but if you waited for 60 days or so, then got married, then you wouldn't raise any flags.

The intent of the VWP is to allow free access to the States for visiting purposes, not for coming here to marry an USC. Remember, marriage alone does not confer any special handling, you still have to pass the interview.

If everyone started to use it to come over just to get married, then they will probably change the rules or shut down the program.

IMHO, using it to get around the wait of the other visa's is a risk - but if people are willing to take it, more power to them.

bobby i know u speak from the 30-60-90 rule...but i know also people wich marry after 10 days and had no problems

and again read the 485 instructions..there usci wrote it in black letters:-))

maybe these ppl were lucky...how many of us can say that any two cases were the same? i just think its wise to know or to accept the fact that there could be challenges along the way. if i was the OP i would be very happy that i have such comments..it would keep me on my toes so i don't get blindsided at the interview. it would help u to prepare even better...work even harder to show a bonafide marriage. does it seem fishy? yes it does, but in the long run the onus is on you to prove your case to the IO. just think if u meet an IO who is hard on u ..what you gonna say then...'goldfee got her case approved why cant i?"

just take the advise and use it at your discretion.makes now sense to come on here and get defensive!

i know a lot people who came over under VWP and merry their loves...not one of them had in the interview the question "what was ur intent when u came in the us" or why did u not make k1 or anything else....

in my case

they went with me thruw the case...ask the no no questions..and then they ask for evidence like join bank account...pics...bills ect...

it was in all interviews wich i know the same....and sure i was well prepared..i brought also my ticket for the flight back and so on..because the people here and in another forum scared me so much that i did something sooooooooooooooo illegal....since the moment people told me hey look again in the instructions....dont be worried....

everybody has fear for this interview because this people decide if u have a future in the us..and if strangers tell u then oh my lord they make ur fear even bigger...this is not really fair!!!!

and i think in some cases the people are envy because they see that another way works too and they were waiting month for k1 ..i dont know wich intent they have to scare other people so much!!!!!

I doubt there is much envy showing up here, but maybe so.

The first question in this case that the interviewer will need to ask is, "Did you use the VWP to come here to get married and stay? It certainly looks like it to me. That was your intent in coming over, right? You hardly got over jet lag before getting the marriage license."

Had they waited a one or two months, the intent wouldn't be such a red flag.

Again, you should read the 485 instructions, specifically, Item F under "Who is not eligible to adjust status?".

Getting married and attempting to AOS will change your non immigrant status. So if they person looking at your case uses that to deny you, your out of luck, not withstanding your marriage to a USC. Remember, the burden of proof is on you, not USCIS.

I did not say people can't get married under the VWP, many people do. Many people get married using the B1/B2 visa.

But there are cases of people of getting denied and sent home, with bans. I know one case personally.

It's a great disservice to make it look like it will be a walk in the park, if your case is strong, then you should not have a problem, but no two cases are exactly the same.

It all depends on who adjudicates your case. If they play hardball, and you have the deck stacked against you, then who will they blame? Some person on the internet that said "it was ok and we did it"?

I also wouldn't say it's "envy", I would rather say it was being cautious. Which is all I'm posting on this subject...
