Jen, I remember your case so well because we were going through our cases at the same time. I'm shocked! I don't have advice to offer...just my thoughts of well-being and peace for you during this awful time of pain and confusion. (F)

awwwwwwwww Jen :( I am so very sorry that this has happened to you. When I read it I had the biggest knot in my throat and was fighting back tears for what you must be feeling....and I really cant even begin to imagine what you are going through. Jen I am so sorry this happened to you. Know that your VJ friends are here for support. You are not alone in this, we are hearing more and more about breakups, but not everyone comes back here to tell their story. You are brave and thoughtful for doing so.

Feel better soon and stay around here for awhile if you can. I for one---miss you!

Hi Jen,

I remember your case very well and I am very sorry to hear abt this, the only thing I can say is get as much evidence that he entered your with false intentions and present this to USCIS. Let them take it from there. Just concentrate on healing.

you just touched on something that i think a lot of people overlook (or don't want to admit). having an international relationship and going through an arduous visa journey does not increase your chances of having a lasting marriage. divorce rate in our country is about 50% ... half of all marriages fail!! that percentage goes up again for 2nd marriages, then 3rd, etc.

you're right ... no one should have to go through this, but reality says that 50% here WILL go through it. i do think it is 100% harder for us to go through it because many people here have had someone in their life doubt the validity of their relationship in the first place. no one wants to have a failed marriage, face your family and come back to VJ. i applaud jen for her courage at this time :ot2:

1. If he received his 10 year GC by mistake then his is still obligated to apply to remove conditions, may get complicated if he does not know/do that.

2. He can apply either with you or divorced, but not seperated.

3. I am sure USCIS receive many complaints from disappointed spouses, unless you have real solid evidence, forget it. Not sure what credibility an affadavit from an ex would have.

4. You should be concentrating on Divorce proceedings, but you are stuck with the Affadavit of Support. By the sound of it your biggest worry would be if he sought to enforce it.

5. If he is seeking US Citizenship, he will have to wait 5 years instead of 3.

Right, in fact if he doesn't apply to remove the conditions he would be out of status and subject to removal. Hmm. I'd keep that one under my hat if all else fails! ;)

Right, he'd have to file a waiver of the joint filing requirement once divorced.

3. I am sure USCIS receive many complaints from disappointed spouses, unless you have real solid evidence, forget it. Not sure what credibility an affadavit from an ex would have.

I would imagine that any affidavit that corroborates the USC's own report of fraud would carry weight. One of the most difficult issues with reporting a marriage entered into solely for immigration benefit, is that often there is little in the way of clear proof. Many spouses "sense" or "suspect" but can't offer definitive evidence. At times, there are those alien buffoons that even announce that they did it to the USC spouse, but it can become a "he said/she said" situation. Having declared something to a third party however, might provide USCIS with more of a suspicion and cause overcoming it a little more daunting for the alien that has duped a USC spouse.

If a report of fraud is filed, and USCIS follows it up and a subsequent I-751 waiver is denied, the Affidavit falls with the status. Likewise if a permanent green card is rescinded, the same goes.

I would be soooo pissed-angry, not hurt and I would do anything in my power to get him deported. That SOB took your time and your money-so #### him. You have all the power. Call USCIS and tell them about this liar and user and have him on the next plan home and permanently banned from the US. There is something fishy going on her and I sure as hell wouldn't want to be a part of it. Protect yourself girl and separate yourself from this guy-move whatever and loose contact with him. Just my opinion.

Are you certain there's nothing that can be done??? Surely if he obtained the GC illegally, there should be some revocation process.

I don't have any answers for you, but I am sorry to hear of your predicament.

I would say the same as Lisa here Jen,

sorry if this advice has been offered before, just keep your chin up you are not the first to have this happen to them and I doubt you will be the last but you entered into this process in all good faith and basically it is you that has been badly let down so you have nothing to feel foolish or ashamed about

how very forgiving and christian of you, anna! :thumbs: is simply telling the truth not good enough in her case? i don't think seeking revenge is the answer here. she's been given some great advice and i don't think your hateful comments are necessary ... try and remember that she's heartbroken right now.

Why is it unChristian and I never said she shouldn't forgive him, but he has NO RIGHT TO BE IN THE USA!!

Shoot-I want to see him get deported. It is people like this that use nice people like Jen that make it hard for all of us to get our fiances here. I feel sorry for her, yes and It really sucks--but this guy has no right to be here and deserves what he gets.
