Hello everybody Im a bit confused my fiance hired a lawyer to take care of our papers we are at RFE now and we are supposed to include G325a that we forgot BUT nothing says letter of intent to marry!! should we include it even though they didnt ask for it ??

I'd fire the lawyer and send in ORIGINAL G325As. 4 pages for each of you plus 2 PP pictures each. Send ORIGINAL letter of intent to marry also. Put cover letter explaining what's enclosed.

Be sure and enclose a copy of receipt notice and the letter that came with the RFE.

Great, another case botched by an attorney. Immigration attorneys are parasites. They delay the cases by months at minimum. Sorry to hear you got swindled.

The G-325 which is required by all petitioners and their fiancess should be the second thing an attorney's secretary fills out after gathering all the information from you to fill in the blanks (yes, it is a tough job being an immigration attorney). His secreatry should do this before the second hole of the attorney's golf game.

All K-1s must have a "letter of intent" from BOTH parties. It must bear the original signature of each party. That means the attorney should have prepared this letter for you and you should have signed it. It is rare for the USCIS to send TWO RFE's, so I guess your signature was forged by the attorney. There's a big surprise.

Also, there is NO SUCH THING as " at RFE " OMG!!! Did the tapeworm attorney tell you this? It means he MESSED UP and delayed your case by weeks more than his golf games normally would. It is not NORMAL to get RFEs. They are sent to people who didn't pay attention to the rules and directions.

You should fire your lawyer and ask for your money back.

It states clearly in the instructions for the K-1:

Letter of intent

B. Provide original statements from you and your fiancé(e) whom you plan to marry within 90 days of his or her admission, and copies of any evidence you wish to submit to establish your mutual intent; and

G-325A

A. Submit a completed and signed Form G-325A (Biographic Information) for you and a completed and signed Form G-325A for your fiancé(e). Except for name and signature, you do not have to repeat on the Biographic Information form the information given on your Form I-129F.

If you didn't include the letter of intent, do so.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Here is the Example letter of intent.

"original" g325 means it needs to (should) have an original signature. Be advised, there are 4 pages and each must be signed.

use the K-1 checklist to be certain that your lawyer included everything else with your petition. If you scroll a bit further down on the page you will find more information about what to send after the petition is approved. Read through the FAQ above and educate yourself to the process so that you can avoid further delays.

thanks for your answer but you though I think RFE is a a necessary step ??????? come on Im not that stupid I just didnt wanna make it long by saying our lawyer forgot the pictures and the G325a so they requested for further evidence !

I will not bash your lawyer. That's your job. I was lucky to find a really good immigration lawyer, but I didn't hire him because I'd be broke right now. Instead, folks out here on VJ continue to assist. The Letter of Intent is very important - one now from each of you, and an updated letter from you after the petition is approved and you are prepping for your consulate interview. Wow, i can't really trust immig. lawyers except for having a good heart to help, but most of them are "Crooks" try to research the guides here is very helpful or you can google "K-1 step by step" good luck....

I will not bash your lawyer. That's your job. I was lucky to find a really good immigration lawyer, but I didn't hire him because I'd be broke right now. Just one more thing about the G-325a, make sure you get the 4 different copies signed as each one has a different code on the bottom left. If you fill it out using Adobe Acrobat it should make identical copies of the information you enter on page 1.
