Hey all,

My american fiance was married before and so I need to present his divorce decree at my interview in a couple of weeks. Does anyone know if it has to be a certified copy or just a copy would suffice? I don't think they really need an original. I think it's in the court anyway.

The instructions only say smth on the divorce decrees from the Ukr side. But I haven't really seen any info on the american divorce decrees. Does anyone know what they ask for at the Kiev counsulate?

Thanks

You can submit a copy of the document with the I-129f petition but an original is usually required by the Embassy for the interview for the visa.

By original they simply mean a certified copy which can be obtained in the County where the divorce was issued.

I know that for the interview that my husband and i are going to have to do for our AOS it says that we should be ready to bring the originals or certified copies of all documents, so if you sent a copy of a birth certificate, bring the original to the interview, same thing with anything important like that. So i would say original, or certified copy just to be on the safe side. Look at it this time, going out of your way and not needing it is better than needing it and wishing you had gone out of you way. Hope this helps.

I would get a court notarized copy and have that to submit. I have heard of the consulate issuing a 221g and requesting further evidence in the form of a court notarized copy of the divorce decree before approving and issuing the visa.

I guess we've been lucky in that they never asked for our originals.

All I had was a copy (of the certified filing) without an original stamp or anything. We brought the same to the interview, but they didn't ask to see anything at all but support information.

From the FAQ's...

http://www.visajourney.com/faq/k1k2visa-ap...tion.html#4.3.6

4.3.6)...What should I bring with me to the interview?

A...You need everything from the checklist, of course, but you also need originals of everything that was originally submitted as a copy, even with the I-129F petition (except the US Citizens passport and the original I-797 approval notice). Original birth certificates, divorce or death decrees, and originals of any documents to support the I-134 fall into this category. The Consulate has the right to ask for the original of any document, so best be prepared.

fwiw... they did ask for original documents at Russell's interview.

Not contradicting at all K&R, just stating that the Kiev embassy (at least when USC attends) generally asks almost nothing and reviews almost nothing. Of course they could start asking any time, on any case. Better safe than sorry.

I think it depends on the Embassy .... with the US Embassy in Sydney we have to send all original documents in before the interview ... they wont schedule an appointment without the required documents ... Which has got me very nervous because I if I dont get them back Ill have to go get them reissued @ $50+ a pop ... They also wanted an original birth certificate and marriage certificate ...

By original they mean ones that is issued by the government department with the official stamp and not a photocopy.... it doesnt have to be the original you received on your wedding day...

A certified copy of what is filed at the court house is what is needed. Take originals of everything to the interview. Don't take a chance of getting there, them asking you for the original and you not having it. Then you have to reschedule the interview and go back to the embassy again.

Good luck with the interview and your journey.
