Hi my frend is here on his K1 visa and he and the girl got married according to their culture customs first on 15 Nov in a temple and then they registered their marriage 20 days later in court on 4 Dec and got their marriage certificate as of 4 Dec. Is it a problem for him in his AOS interview ? i mean do they take it seriously ? r they gonna ask tht the marriage is not according to their rules ( i mean first court marriage then traditional ) ???????? or is there any such rule ? please guide !!

A legal marriage is a legal marriage. As long as it took place within the 90 days of entry there should be no problems.

If they have registered their marriage in a courthouse and recieved their marriage certificate then I cant see how that is a problem ... I dont think there is any law that states you have to get married in a certain way as long as the person who is performing the marriage is the right qualifications to perform the ceremony ... People get married in hot air balloons, paracuting out of airoplanes, deep sea diving .. there marriages are no less legit then those married in a church with a priest or minister ... but the person performing the ceremony must have the right qualifications....

If it is recorded and they have a marriage certificate, it is a legal marriage. The government will consider Dec. 4 as their official date of marriage, your friend and his wife can celebrate any day they wish.

So i guess i shud ask them not to wrry abt the dates. So they can tell the immig. tht they did the party on 15 according to their traditional and registered the marriage on 4th . I hope immig will not create a prob for this - or is it?

I had a wedding "ceremony" with my USC, friends and family in late sept and we were married by a friend (in the State of Colorado, you can marry yourselves once you have your marriage license in hand and do not need to be married by a priest/officiant etc). A few days later in early october we went to the court house and were married legally by the magistrate. This is only due to the fact that we wanted to get the magistrate to fill in our marriage license so that we would have no issues with USCIS not knowing about the different state laws for marriage :-))) and with our AOS.

For our AOS, we used the date of when the magistrate married us as this is the date on our marriage license, which you will need to submit for your AOS.

During our AOS interview, I stated that we had a ceremony in sept, but our official wedding date was that in october. Now we have two dates to celebrate ;-)
