Hello to all members

I recently went thru a k-1 visa process I am an american now married to a Thai

I did all the paperwork my self.

We entered the Usa got married.

I have now encountered problems with

the adjustment of status.

Four weeks ago I submitted all paperwork included in the guide on your forum

I 485,I 765,I131 photos tax records coversheet

It was returned 2 weeks ago with a rejection notice attached to the I 485,I 765,I 131

It says check amount incorrect. I called the number provided and they assured me

the check amount was correct $ 930.00 + $ 80.00 total $ 1010.00 that was the amount I submitted.

The person on the other end walked me thru a few thing I then discovered I inputed the wrong

code on form I 765 question 16 I then changed it to C 9

I resubmitted all the same paperwork again waited 2 weeks.

It was just returned today same notices attached.

I called the number on the rejection notice again and talked to a person she assured me the fees

were correct.

Can anyone tell me what I am missing.

Should I submitt 2 checks $ 930.00 filing fee then an additional check for $ 80.00 fingerprint fee

There is nothing else that I can think of I have done wrong, is this it

Any suggestions would be appreciated

One check for $1010 is fine (even states so on the instructions page(s) - with no children. They are specific on who to make it payable to and check/money order must be drawn on a US bank. Other than that - it's difficult to say. What exactly is the wording on the return notice?

The amount is correct. I had a child also and sent one check for $1,610 and all was OK. Sounds like some Snafu to me. Maybe include a letter with a copy of the instructions and say "please do not send it back, the check amount IS correct"

The check is a us check made to USCIS

The rejection notice reads for the i 485

The check amount is incorrect or has not been provided The correct filing fee is $ 930.00

Each applicant between 14 &79 must incluce an additional fingerprint fee of $ 80.00

I got my check returned it was made for the amount of $ 1010.00

Am I making the check to the wrong dept should it be department of homeland security?

The i 765 rejection reads correct filing fee 340.00

Unless you are submitting with a I 485

The I 131 rejection reads correct filing fee 305.00

unless you are submitting with a I 485

Am I checking a wrong box some where

I checked I 485 box C

There is NO FEE for the I-765 nor the I-131 when filed with the I-485 (that could be part of the problem) - sending too much money?

can anyone see anything that is obvious I have missed I am sure the fees are correct.

Is the check to USCIS a snafu

I have just noticed the returned check has a us Department of Homeland security stamp on the pay to of

the check.

The instructions for payment under fees or fees waiver read send to dept of homeland security Or us citizenship and immigration services

The paying immigration fees section says to make payable to Department of homeland security.

Am I just reaching here

When I re submitt I will use Dept of homeland security

Take a look at the example forms here on VJ to see if you match up. Sometimes it is the little things like blank questions, etc. Good luck

Just double ckeck if you put the correct date of birth...this might be the reason......

"Have faith in God, Jesus answered. I'll tell you the truth. if anyone says to this mountain, Go, throw yourself to the sea, and that does not doubt in his heart but believes that what he says will happen. it will be done for him. Therefore I'll tell you, whatever you ask for in prayer, believe that you have received it, and it will be yours" (MARK 11:22-24)

Try making it out to the US Department of Homeland Security. I think I remember reading somewhere that the initials are not recommended for cheques, that it is the full name US Department of Homeland Security. That is what I made our most recent cheque out to and it was accepted. On the memo part of your cheque write your A# and then break the cheque down into the AOS fee and the biometrics fee so they see what it is for.

Good luck.

Yes, here is what I was looking for:

Paying Immigration Fees

Use the following guidance when paying filing, biometrics, or other fees to USCIS:

* Bank drafts, cashier's checks, certified checks, personal checks, and money orders must be drawn on U.S. financial institutions and payable in U.S. funds.

* Make the check or money order payable to U.S. Department of Homeland Security (not "USDHS" or "DHS"), unless:

1.

You live in Guam and are filing your application there. In this case, make it payable to Treasurer, Guam.

2.

You live in the U.S. Virgin Islands and are filing your petition or application there. In this case, make your payment to Commissioner of Finance of the Virgin Islands.

3.

You live outside the United States, Guam, or the U.S. Virgin Islands, and are filing your application or petition where you live. In this case, contact the nearest Embassy or consulate of the U.S. Department of State for instructions on the method of payment.

Can not be "USCIS" - Must be "US Department of Homeland Security" Says exactly that in the instructions. If this is the only error you made then simply writing another check, with the proper pay-to-the-order-of on it and your problem is solved.

AGREED

My wife's AOS was rejected the first time around from putting the wrong Date of Birth, which would have caused the fees to change. We put 2008 as her birth year which would have meant she was 0 (yes, zero) years old and not requiring her to pay the biometrics fee.

We tried the whole Infopass deal before we discovered the problem. The folks at the LA office were complete lame brains. It was a total waste of time. In the end, there was one officer from NY who spoke with on the phone at USCIS who researched the problem and called us back to tell us. Thank God for her as she saved us a lot of heartache.

Best of luck to you and be sure to let us know the outcome!

Same thing happened to me... I first sent a check for $1010 with my application (AOS & EAD) and they rejected it saying that the fee was wrong. Then I sent my application in for the 2nd time with 4 checks for $ 930, $80, $355, $340. I know that I didnt have to send in the extra money, but I am just so tired of USCIS being so ineffective and idiotic. Btw, they cashed all 4 checks.
