I went through a divorce because my wife charged up 100,000 in credit card debt and is still going. Even though I still can not explain how she did this and where the money went (she handled the budget), I walked away with half the responsibility. OK. now I an divorced and I went to China for business and met a woman that I fell in love with and want to marry. I have a steady income but I want to do a bankrusy. I am up to date on bills but with minimum payments of $1000 month I want to eliminate this and start over. Should I do a bankrupsy before or after the K1 fiancee visa process. how will a bankrupsy on my record effect the process or if it is a big deal, then how should I face this. My advantage is that I have a steady job and $60000 equity on a house that I want to live in till I die," even with the bad housing market". No I refuse to put my ex-wifes debt on my house. My house payments are $500 a month in a nice place in Florida, I will retire there so I do not want to mess it up. I'm 38 now.

Obviously going bankrupt during the immigration process isn't positive. At the same time if you make enough after payments or get a co sponsor you should be OK.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Unless there is something unique to China, there is no credit check or consideration of liabilities in the process. If your income meets the guidelines they do not check credit or what your monthly payments are. I would say it is not a problem at all. If someone with a fiancee from China can say different...they will. :)

You probably want to check with a lawyer about how you discharge your debt and not lose your house. It isn't like you can say forgive my bills but let me keep my stuff

Unless there is something unique to China, there is no credit check or consideration of liabilities in the process. If your income meets the guidelines they do not check credit or what your monthly payments are.

This may not be entirely accurate. A Thailand poster, Daboyz, said that the US Consulate in Bangkok was aware of an IRS lien and initially denied his wife the visa on account of that lien bringing his annual salary to below 125% of the poverty line. He never disclosed this at any point, but somehow, obviously through a search, they found this.

I would definitely research this further. Wish you all the very best. I am confident that if you are determined enough, you and your beautiful Chinese fiancée shall be together in America.

There are many things 'unique' to China. Getting through the process there, and in some other higher fraud Countries, is hard enough without adding even more red flags. ;)

Hopefully pushbrk will chime in with more on how China perceives this issue but you can certainly visit the China Regional forums here on VJ and I would also suggest you read all you can at candleforlove.com .

My guess would be that as long as you meet the minimum requirements you might be ok (even tho it's still a battle). Unless, of course, the IRS puts a lien on your income as stated above.

I would go full forward with K1, and conulte a Bankruptcy Attorney regarding filing bankruptcy.

Laws changed regarding Filing Bankruptcy a few years ago, Stay away from any Credit Repair place (they are mainly scams).

I've seen no evidence Guangzhou cares about bankruptcy or credit issues or anything financial when the income is over about 30k. (Yes, I've seen them ask for co-sponsors from people who meet the minimums.) I don't see an immigration problem for the OP but I think he'll find that people at his income level no longer have a Chapter 7 bankruptcy available to discharge their debts. That changed a couple years ago. You can restructure but not completely discharge. At this point, generally people who CAN pay their debts are required to do so.

Facts are cheap...knowing how to use them is precious...

The second is just a stupid sexist remark and it will not be tolerated on VJ. I am personally offended by this comment (as i'm sure are many other perfectly capable women on this board) and that in itself is a violation of the TOS that you agreed to when joining.

You really have to feel sorry for any woman that is in a relationship with a man with such a lack of respect for her abilities as an individual. He has to hope she isnt capable of personal growth to the point she realizes what is up and kicks him to the curb.
