Is it possible to apply for a visa when the husband has a record of a sex crime.

I know a person who is starting the process of appling for his wife who is 18 and just found out he has this record. Am I right in thinking he doesn't have a chance of getting approved?

If the sex crime was against a child, then the road would be long with not much hope for success. USCIS is just beginning to figure out how to deal with petitioners having criminal convictions that fall under the Adam Walsh act and I've seen no evidence of any such petitioner getting approved. There are numerous challenges in the system but, to my knowledge, none have made it through the system with a definitively positive result.

Facts are cheap...knowing how to use them is precious...

The crime was with a 13 yr old girl.

But what if he lies on the form and doesn't report it will it be caught?

Timeline: 13 month long journey from filing to visa in hand

If you were lucky and got an approval and reunion with your loved one rather quickly; Please refrain from telling people who waited 6+ months just to get out of a service center to "chill out" or to "stop whining" It's insensitive,and unecessary. Once you walk a mile in their shoes you will understand and be heard.

They do background checks; they will find out. And if he lied about it, what little chance they had has just vanished. A good immigration lawyer is needed here but the others are right, chances are very small. Can he go and live in her country?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

He has no chance. He can lie, but he will get caught. Anyway, why would someone want to marry this child molester?

Please do not suggest this idea. It will be easy for him to haunt children in Philippines.

Given the heinous nature of the crime, there is no chance at all that he will be allowed to bring a teenager to the U.S. as his wife. Merely his SSN will trigger his criminal record, so there is no way for him to hide it.
