I'm would be very grateful if anyone can give me any advice on this.

I am 47 year old UK woman who back in 1978 in the UK was convicted of 3 charges of CPL ( common prostitute loitering) First two charges I recieved fines and the final one I was given a 12 month deferred sentence. Yes it was stupid of me and yes their were circumstances why I ended up in that position - but since that time ( 28 years ago) I have not so much as recieved a parking ticket. let alone any further criminal charges. I left that life far behind me.

I am now very much in love with a USC ( he is fully aware of my past) and we wish to be married and for me to move to and reside in the USA. I have read what information there is available online but am still unable to determine if these charges given the rehab time period would still be considered relevant enough grounds to deny me access. I am aware of the waivers available for those with criminal records and I was hoping that I may well be considered a *reformed* character .

I appreciate that I may well fall foul of the *moral turp* regulations but I am again hoping that the 28 year *rehab* period would help me in this respect.

To further complicate this issue I have been worried about even flying out to meet this guy (a pre-requiste as I understand it for the Fiancee visa application ) as It would require me going via the GWP and hence could possibly become an issue should I then apply for a K1 in that I would have previously entered under the GWP illegally :( He is unable to visit me without being accompanied because of his severe medical condition :( I will jump through whatever hoops I need to to be with this man I am just very wary of doing the *wrong* thing and possibly endangering ANY chance of us being together. The whole thing is a total nightmare for us.

ANY advice on the best way to proceed on this would be very much welcomed

You crime has made you inadmissible to the US. You can apply for a visitor visa to be able to come to the US at your local consulate and with some time it will very likely be approved due to the offense and the time since it was committed.

For the K-1, you must report the crime on your forms... A crime is a crime, no matter when it was committed. At the interview, the visa will be denied and you will be invited to file a waiver of your inadmissibility. You should have this prepared ahead of time and give it to them at that time. However, the good news is that London routinely approves these waivers. Especially in your case when the offense was non-violent and the amount of time since the conviction. In essence, it will just be another "hoop" that you'll have to jump through.

Go to the I-601 Waiver Forum and ask questions there. They will be able to guide you about waivers, what you need to do, attorneys to contact, and what may be required of you...

He can visit you if you are worried about visiting him - or you could meet in, for example, Canada or another country.

I wish you the best - I know however old some convictions are, if they fall into the moral turp category they don't take into account always how long you have been a stand up citizen. I do wish you luck (F)

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

July 27th - Married!! :-)

Aug 7th - Applied for SSN in married name

Just an idea to satisfy the meeting in person requirement of filing the I-129F.....Is there any way perhaps of you meeting each other in Canada? Less distance for him to travel.

Thank you all SO much for your warm wishes and helpful advice. This wasnt an easy post for me to write as it is something I am very ashamed about and obviously that I had hoped I could leave buried in my past. I will follow through on the advice - and the Canada meet is an excellent idea as I have family there :):) He would still need to be accompanied for the flight but the distance is significantly less :)

Like i said I will jump through WHATEVER hoops necessary and if that means I have to discuss my past with whatever gvt officials then its a SMALL price to pay for the chance for us to be together :)

Another possiblity for you may be to contact the London embassy and see about getting a regular tourist visa (B2) - if you're worried about trying the VWP (visa waiver program). I don't know too much about them or what they require, but it may not hurt to do a little research.

I think you'll be pleasantly surprised at how understanding and compassionate Vjer's are. After all, we're all humans who make mistakes (certainly myself included) and it's nice to see no moral bashing going on.

That being said, I would certainly prepare to file a waiver. It does help that this was a 1/3 of a century ago, but nevertheless, be prepared to be questioned about it. You sound like a good candidate for the advice of an attorney, who can tell you the best route to take in all this.

I have read and re-read the papers on just what you are asking, and still do not understand it !! although what you did is a crime of moral turpitude there is a piece that I read that states that a visa "may" be given if the crimes were of a certain age and occurred a certain amount of years before the visa application and that the person can show total rehabilitation and is now an upstanding citizen and can prove it. That is definitely not to say that it is cut and dried that if you did all those things you would get your visa, :no: There may be many hoops to go through and one will, I should imagine, definitely be a waiver as at the end of the day, it is CIMT

We are in the same boat in a way as my hubby (we are both in the UK going through our daughter, the USC) did some stupid things as a young man, only one could be classed as CIMT (and he did not do jail time) and they were 28 and 34 years ago but we have a waiver all prepared, just in case, but we also have references from the business community, he has had his own business for over 20 years and is well respected within the community and also personal references. so thay can see that since his last offence of 28 years ago he has never put a foot wrong.

What I would do if I was you would be to consult a legal bod who is an immigration lawyer as to what can be done and what would they advise re the VWP because you cannot lie on that :no: But a word of advice here, there are scams out there and you will have to tread carefully as you could get ripped off. I know of one in particular that advertises they can get you over there even if !!!! so if you would like to pm me I will give you the name of them and then you will know that at least you can avoid that one. :thumbs: Good luck :thumbs:

If you want to go the K-1 route-I would suggest checking out immigrate2us.net-there are several really good waiver letters on there. I saw one specifically for a crime of moral torpitude-It was for a crime that was commited about 25 years ago.

Not sure if I understood you right, but have you met in person before? Because if not, this would be the first hurdle you need to take, if you really decide to file for a K-1 visa.

I think, to meet in Canada or so would be a good thing to do, because of the obvious reasons, but I remember when I went to see my fiance the first time, after we met online, I had to answer some really stupid questions at the Immigration office, even had to go to secondary inspection and was told to be careful because "he could be a psycho, trying to kill me". I am serious, that's what they said.lol

I can't give you a lot of advice, but I certainly hope, this all will take a good end for you guys!! :thumbs:
