My fiance is here on a k-1 visa. We were getting the papers together for the adjustment of status, and are running into trouble getting a financial sponsor. Right now I am not able to sponsor my fiance; I have someone who can do it, but until recently we didnt realize how big the commitment is and now the co-sponsor is unsure about it. We are getting married within the 90 days of the visa, so if we are unable to sort out the sponsorship issue, can we stay here? Or do we have to go back to his country (Turkey) before the 90 days are up? Are there any alternatives to the permanent residence so that he can stay here until we have enough money so that he or I can sponsor him?

Most important is for you to get married within the 90 day timeline. As long as you are married within the 90 day timeline, you can wait to file AOS (some people have even waited 2 years to file AOS, ofcourse this is not ideal); or you might get someone along the way to co sponsor your application. If you do not marry within the 90 day period and the fiance returns to their home country, it complicates future applications???? Bottom line, go ahead and get married before the i-94 expires first....

I agree, the most important step is to get married before his 90 days are up. After marriage you can take your time in trying to get another co-sponsor so you can file for his AOS.

I want to make sure that there wont be any sort of illegal immigration or visa violation type of thing put on his record, which would make it really hard later if we try again to either get him a marriage visa or permanent residence.

We're getting married in a few days, and I think my 2009 tax return next year will be enough to sponsor him, so if I try to wait that long, whats the worst that could happen?

As stated - the number one priority is to marry within 90-days of entering the US (before the I-94 expires).

Once married and once the I-94 expires - he will be out-of-status - not a huge issue, but not the best circumstance either. To protect his legal status, you will want to file for AOS as soon as possible (of course).

Note: You do not have to wait until you file your 2009 tax return in order to show your income situation has improved. Letter from employer along with pay stubs would show that. :thumbs:

Besure you marry within the 90 days, wait to adjust status when your financial condition improves, he should not leave the USA.

Yes go ahead and get married. There are people here on VJ that have waited 2 years or even more to file for AOS and they have been fine. You will be out of status but thats better than not marrying within the 90 day timeline. Like someone said above; you do not need to wait for your tax returns to file for AOS. A letter from your employer(s) verifying the amount of money you are making and pay stubs should do for the AOS.
