ok so here's the situation...I've already applied for k1 visa...when my fiance was 17 he was arrested , took a plea, and was given 364 days in jail and 5 years probation...he turned 18 while being locked up and his mother persuaded him to sign a form for voluntary deportation...We just found out recently what she did ... he trusted his mother and never questioned what she asked him to sign she told him that it would be best for him to go to Jamaica for five years then after 5 years she would reapply for him, which she didn't...it's been 7 1/2 years now and while going through the process for the visa on his criminal records he now has a charge for violation of probation b/c he left the country even though it was a voluntary deportation..and that's how he has the warrant out for his arrest...So now basically I'm stuck and have no idea what to do now...but i did make an appointment w/a immigration lawyer...So is it possible that he can get approved for the visa but once he goes through custom get arrested? or will they just deny the visa b/c of the warrant?

The conviction on his record will either make him inadmissable, so that a visa is not issued or it won't. If he is granted a visa, chances are he can deal with the past offence after arrival. You're on track seeing an attorney.
