OK to send DS-230 while I-864 still pending(RFE)?

I am ready to send the DS-230 but received an RFE requesting more tax records for the I-864. I requested transcripts from the IRS on 12/24 and am still waiting for them - should I wait until I can send both DS-230 and I-864 together or send DS-230 now? My husband's PCC is dated 10/1/08 and I am worried maybe it is only valid for 3 months??

I believe the I-864 and DS-230 are processed along two different pathways so you should be okay to send it along.

Anyone else know? Pleae correct me if I am wrong.

Yes, the I-864 has nothing to do with the DS-230. So if you already paid the IV Bill, the NVC said they generated the DS-230 coversheet, or you paid it online and are able to print it from their web site, and you're ready to send it, go ahead and send it. The sooner the better.

Pattu Rani,

I-864 and DS230 are two different path so, dont worry go ahead send your DS230 package. PCC is usually valid for 6 months, you should not have to worry about PCC getting expired.

It would be helpful if you told us what you have sent/are going to send, and then someone can tell you if you have the correct documents.

The requirements are on the I-864 instructions. You can send your tax return for the last year, with all supporting slips - or you can send a transcript from the IRS.

The requirement is for last year's return - however you can send the last 3 years if you want to - you need to have the last 3 years on hand anyway as they can be requested by NVC or at the interview.

Actually we haven't started assembling the I-864 yet co'z they might be needing the 2008 Tax Records. They just generated the DS-3032 and AOS fee bill, we haven't receive the hardcopy yet but I already emailed my Choice of Agent today. So we're expecting to send the I-864 around the end of January or early February. I am not really sure about this. If thats the case, should we include the 2008 tax records?

I also kept a lot of the pay stubs I have done since two years ago.. so they shouldn't have any reason to see why I can't support my wife.. two years is a good thing to show them that it is not just a new job and you actually have been working.. (at a constant or increasing salary, of course)..

I sent a photocopy of my 2007 1040-EZ and original W2. I would have sent photocopies for 2005 and 2006 as well but couldn't find the W2s and the I-864EZ didn't specifically ask for 3 years. I make well above 125%(though still struggling for NYC LOL) so thought it would be OK. I also sent 6 months of pay stubs and employer letter. I should have called the IRS for transcripts in the first place - I guess they're more official than photocopies of the return. I requested 2005-2007 transcripts so hope they will be here soon.
