I am filling out the I 864 form for my wife. I am the Petitioner, and my wife is the immigrant. She is here on a K3 Visa. My main job I work under the table, and I have a small part time job on the records. With my job on the records, we dont meet the income requirements. My wife also works, but she only makes 10k per year. I am having my mother as the co sponser (joint sponsor) . My mother has all the paperwork she needs and completely meets all requirements.. My only problem is my end of it. It says the petitioner must also fill out the I 864. Last year I did not pay my taxes, and I still dont have enough money to pay them. If I dont send in my taxes, but my co sponsor has everything A ok.. will my wife pass?

If possible, include your tax information from 05 and 06. Unfortunately you are goign to have to file for last year. You can submit proof of filing for last year with your AOS package and include a small explanation as to why you didn't submit a tax return for fy 2007. Set something up so that you can start making payments on the money you owe. You jeopardize receiving an RFE if you only submit your 05,06 returns (if you have them). If you don't have those returns, do the same as above and include a letter explaining why you did not do so.

You're right, USCIS expects both the petitioner and the co-sponsor to submit a fully completed I-864 with your AOS package.

Can you give me a pointer as to where to start in contacting the IRS, and what I should ask them? I usually went through H+R b;pbk, but this is the first year I missed payment, and I dont know where to go or what to do. Can H+R block help me set up to make payments to the IRS, or should I just contact the IRS directly? Is there a way to contact them online?

Also we are getting really late on this.. I think my wifes visa runs out in 5 months.. What is the deadline to turn in her application for AOS?

Talk to a good accountant. Most don't charge much and can save you BIG bucks.

Did you know they add on money for every day past April 15 2008 that they aren't paid? Did you actually file and just not pay? If you didn't file, you missed out on the 2008 Economic Stimulus Payment---up to $600 for singles and $1200 for married couples. The deadline for filing was Oct. 15, 2008.

IRS.gov is the website with lots of information. And you can call them and ask questions. H&R Block is expensive. Ask the IRS first.

I already am legal.. I was born here.. I am petitioning my wife. Last year I worked for a company doing home thaetre installs, but they did not take taxes out, I had to do that myself, and it was like $400+ with HR block fees and everything, and I just dont have that kind of money sitting around. After gas and tools and everything I only made about 12k that year. This year I am working as a pizza delivery guy.. most of my pay is in tips, but i also get a small hourly pay.. but its a small restuarant owned by one man, and he doesnt have me on the books.

I want to make my wife legal who pays taxes and works a full time job. I do intend to pay my taxes, I just dont have $400.. it took me all year to save the $1000 i needed to do the paper work

If you intend to file return and pay tax, the earlier the better, because interests and penalties for unpaid tax amount are accumulating (which continues accruing until you file and/or pay delinquent taxes). If you will call IRS, they will give you the exact amount of interest and penalty as of the date of the call if you tell them the amount you original owe them.

I believe you need to use the tax form for year 2007 (2007 Form 1040, etc., and not form for the amendment as it will be the original return) which you can obtain from IRS website.

If you cannot afford to pay the tax in a lump sum, you can ask IRS for an installment payment (see the below link to IRS page) -- Interest will still continue to be added until you finish your payments, but it will stop accrual of the penalty. (I am not sure for the implication for AOS filing if you do install payment).

The irs.gov site has a questionnaire that lets you know if you need to even file taxes. It can be found here.

I'm a little confused as to your situation, but maybe browsing the irs site will help you out. There's a ton of info on it.

If you don't have to file taxes, don't. Let your mom co-sponsor (which you probably need to anyway) and use all her info. There are many people who are full-time students

during this process & have a cosponsor. They don't have tax info on themselves either I'm sure.

I don't get how you can owe so much money if you hardly made any. Are you sure??

Sorry I dont know alot about taxes, but whats the diffrence between filing and paying? How would I file my taxes without paying them? Ive enever done my taxes myself. Do I just fill out the appropraite tax form, and not include a check?

I think you can file tax return without paying any taxes at the time of filing it or pay just partially (for example, Form 1040 has space how much you will pay now, how much you owe IRS after such payment, etc). You will receive a bill from IRS afterwards, I think.

The best way is to file Form 1040 (assuming this is the form for you) together with Form 9465 (Installment Agreement Request, http://www.irs.gov/pub/irs-pdf/f9465.pdf). In Form 9465, you can put any amount you are willing to pay every month (you need to finish payment within 60 months). IRS will send you a bill every month containing new balance. (Remember, interests will be added for the unpaid portion).

If you propose to pay, say, $40 per month in Form 9465, I would recommend to send at least $40 check with Forms 1040/9465.

The posters who are offering filing & payment advice may be (double pun) right on the money, but confirm the correct approach and your options with a Tax CPA or with the IRS itself. I would personally NOT contact the IRS first, without the benefit of professional advice beforehand, but what you choose to do is up to you.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
