This question may seem stupid.. but I clearly find it interesting..

What is the actual status of a person adjusting status on the US?

-other than K-1 visa ... (ie B1/B2 visas. F/1 etc) no SSN

Love timeline!

08-11-06.........Met my love at my friend's party... got my eyes on her :)

10-20-06.........I finally make you mine!!

01-16-08.........Civil Wedding!! .. :))!! Officially married

AOS

11-07-08 ....... Sent AOS package to Chicago

11-11-08.........Packet delivered Yay!! (day 1)

11-20-08.........Money order's cashed!! (day 9)

11-26-08.........NOA'S in the mail dated for the 18th of November (day 15)

12-09-08.........Biometrics done! (day 28)

12-10-08.........I-765, I-485 touched! (day 29)

01-15-08.........EAD card production ordered! AP notice approval sent ! (day 65)

02-24-09.........Interview @ 12:00 pm !! (day 105)

AOS pending?

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

If you arrive via VWP and you apply for AOS you are out of status after the I-94 expires.

If you arrive via VWP and you have applied for AOS then your status is AOS Pending. You are only out of status if you have not applied for AOS, But that applies to K1 and any other visa where you have not applied for AOS befor the I-94 expires.

10/01/08 Sent package to Chicago Lockbox

10/03/08 Package received at Chicago (Day 1)

10/10/08 Checks cashed per my bank (Day 7)

10/15/08 NOA's for I-130, I-485, I-765 (Day 12)

10/20/08 Biometrics appointment notice for Nov 4 (Day 17)

10/22/08 Notice for RFE showed on online (Day 19)

10/27/08 Notice for RFE hard copy received in the mail (Day 24)

11/04/08 Biometrics done (Day 32)

11/10/08 Sent RFE letter with missing initial evidence (I-693) back to USCIS ( Day 38)

11/12/08 Initial evidence (I-693) received by NBC (Day 40)

11/17/08 Response for evidence received, case processing resumed (Day 45)

12/10/08 EAD card production ordered (Day 68)

12/16/08 EAD card production ordered again--Send the damn card already!! (Day 74)

12/19/08 EAD Approval Notice Sent (Day 77)

12/20/08 EAD and interview letter received in the mail (Day 78)

2/24/09 Interview @ 8am ( Day 144) - AOS APPROVED..PASSPORT STAMPED!!

3/2/2009 Received Welcome and I-130 Approval Notices. WE WELCOME YOU TO PERMANENT RESIDENCE IN THE USA!!

3/7/2009 Received permanent resident card in the mail.

11/24/2010 Remove Conditions (Day 635)

If you were out of status and then applied, does that make you legal, or are you still illegal or out of status, until you get approved?

My timeline:

11-20-2008: AOS (I-485 & I-130) Package sent.

11-24-2008: Package received at 1.36pm and signed by JCHYBA.

12-04-2008: AOS Check was cashed!

12-05-2008: I-130 Money Order was cashed!

12-08-2008: Received my 3 NOA's and letter for biometrics

12-19-2008: Received RFE and another letter for biometrics

12-22-2008: Sent response to RFE back

12-26-2008: Biometrics appointment! -canceled due to holidays-

01-02-2009: Response to RFE received and case is resumed

01-13-2009: Second biometrics appointment - DONE YAY!

01-26-2009: APPROVAL of EAD!!!!!! YAYYYYY!!!!!!!!!!!!!!!!!!!!!!!

02-04-2009: Received EAD card in mail and applied for SSN - Picked up SSN day after!

02-06-2009: Passed written test, got driver's permit!

02-10-2009: Received my SSC

03-20-2009: Interview! - RFE

04-14-2009: Brought the requested document to the immigration office.

05-02-2009: Received our 3rd RFE.

05-11-2009: Brought the requested document to the immigration office.

05-27-2009: Received green card YAY Thank you God

04-04-2011: Sent in I-751 Removal of conditions

07-08-2011: Approved!

07-14-2011: Received Permanent Resident Card! WHOOOOO HOOOO we are done!!!!!!!!!!!!!!!!! Thank you GOD!

Out of Status but LEGALLY in the USA waiting for decision on the application (in her words kind of legal limbo)

at that time no action can be made against you by DHS (removal, deportation)

then the decision comes ;)

05/03/2008 call to USCIS because NOA1 not received ;( Got the receipt number and was told that we cannot get replacement NOA1.

08/21/2008 request for NOA1 for I-130 to file AOS placed over the phone and forwarded to VSC. Thanks to the first great Rep at USCIS hotline

10/17/2008 Hubby`s B-day, NOA1 for I-130 finally arrives!

10/21/2008 AOS sent to Chicago lockbox

10/31/2008 NOAs for AOS received

11/06/2008 I-130 is transferred to CSC

11/20/2008 biometrics done

12/02/2008 I-130 APPROVED!!!

01/02/2009 EAD received

02/12/2009 Interview APPROVED!!!

02/17/2009 welcome letter received

02/23/2009 GC received!!! yay!!!

11/18/2010 I-751 Sent to VSC

11/22/2010 NOA1

01/07/2011 Early Bio

01/27/2011 Scheduled Bio

05/11/2011 RC approved

05/17/2011 GC received

Naturalization

11/14/2011 Sent package via Priority to Nebraska SC

You are legally here, without question. If you are not granted adjustment of status, then you are no longer legally here.

actually that is the official USCIS term for us. Just simple "AOS pending"... and that means that you have the right to wait for their decision on your I-485 on the US soil ... :)
