A US couple are suing McDonald's for £2m after nude photos of the woman, which were on her husband's mobile phone, ended up on the internet.

Phillip Sherman says he accidentally left his phone, with the photos, at a McDonald's in Fayetteville, Arkansas, reports the BBC.

He says staff promised to secure the phone until he could retrieve it.

But the Shermans claim they had to move home after the woman's name, address, and phone number appeared online along with the photos.

Tina Sherman says she began receiving offensive calls and text messages about the pictures from her husband's mobile phone after he left it at the McDonald's on 5 July.

The couple then discovered that the nude pictures she had sent to her husband's phone had been posted online.

The Shermans are suing McDonald's Corporation, the owner of the franchise involved and the restaurant's manager, saying they have suffered emotional distress, embarrassment and damage to their reputations.

McDonald's has so far refused to comment on the case.

Given how many people (*coughmostlywomencough*) lose their cell phones, this is why you keep the porn pictures at home, and not on your cell phone. Once you leave it elsewhere, especially in a public place like McDonalds, you expose yourself to losing your privacy. I wouldn't give these people a cent.

Hmm, I'd like to give them the benefit of the doubt but I smell a rat......isn't this just another way of bringing a mouse into MC's and claiming to have found it in your burger?

Hope they didn't do the uploads themselves......

they aren't entitled to look through the phone. given that it was in the possession of mcdonald's employees, they are up s### creek without a paddle.

I guess to see who's phone it is, they gotta look through it. Indeed it's irresponsible, but mainly the irresponsibility is from the owner of the phone leaving it in public. I consider it equivalent to having a porn locket on your set of keys, losing your keys somewhere, and someone taking a picture of it and posting it on the internet. Once you leave your home and bring these things out into the public, one should not still continue to have a very ambiguous definition of privacy.

Media prosecution - gotta hate it! Why don't we wait for the trial before we start finding guilt? Come on people. It will have to be proven that McDonalds or their employees did this and that is a long way off. So far all you have is the filing of a lawsuit, no finding. Relax.
