As soon as possible after your marriage if you don't want to become out of status.

Thanks for the reply...when i will be out 0f status?im sorry,i was just confuse...and also....is there a way to extend my stay here while we were still on the process for applying for aos?i arrived here last oct.7 and my I-94 expires on jan.5,2009...it will be a month since me and my hubby got married....

Technically, you are out of status when your I-94 expires which is 90 days after you enter the US. You must get married within those 90 days, but you can actually wait to file AOS. There is really no time-limit. Your "overstay" will be forgiven when you are approved. Most people file as soon as possible so that they can work and travel.

You cannot work or travel outside the US until you have your EAD and AP, or your GC.

This explains well.. though it doesn't says it's a must before I-94 expires but its advisable after the marriage and before the I-94 expires. It's up to you. I know that it's a bit expensive. That's the reason sometimes of the delay of filing.

Good luck! you have to prioritize the marriage first before 90 days.

Yes, you can file after the I-94 expires, there is no time-limit to file. You will be out of status for a while but that will be forgiven.

My husband and I got married Oct 2007 and had plans to travel in dec and march...when we called the service center they advised us to wait till our travels were over with to file, so we didnt file till May of this year!

I would say there is no real time period, as long as you dont violate your visa, I was here on student visa so the I-94 didnt really concern me, since i was still enrolled!

Nov. 2006---------Engaged

Oct. 20th, 2007---Married

May 26th, 2008---AOS/AP/EAD sent

May 29th, 2008---Package Received

June 7th, 2008----4 NOAs Received

July 3rd, 2008----Biometrics App

July 11th, 2008---Medical Completed

Aug. 14th, 2008--AP Received

Aug. 21st, 2008--EAD Received

Error Found on EAD :(

Sep. 30th, 2008---Correct EAD Received

Oct. 1st, 2008-----Interview Date Received

Oct. 17th, 2008---SSN Received

Nov. 7th, 2008----AOS Interview

Nov. 14th, 2008--Welcome Letter Received

Nov. 21st, 2008--Received Green Card!!!
