Pls help with setting up I134 affidavit of support

Hi,

I've been looking into the affidavit of support (sponsorship) I134 and hope someone who understands it well can give me a few pointers.

* I'm not currently working (will get a job when in the US) and no assets to speak of (I = beneficiary)

* My fiancee (= US citizen petitioning for K1 for me) is a student. She does not have a job or assets either. She lives on student loans which she receives each quarter, and which are just barely sufficient for her tuition and living expenses.

* Both of us spent most of the past year doing a trip around the world, i.e. not working or making money.

My fiancee's stepfather has plenty of income and has agreed to sponsor me and do the necessary paperwork. It's a solid commitment, so the $$$ is there. I just want to know how to get it on paper the right way!

So, the summary is that ALL the money comes from the stepfather, and NONE from my fiancee, really.

The questions :

1/ Do I file with just one sponsor, i.e. her stepfather? Or do I file with my fiancee as the sponsor, and her stepfather as the cosponsor?

2/ If she needs to be a sponsor, how does that work? Do her loans count as "sufficient to take care of herself, but insufficient to support me also"? Or do they count as the *negative* income they really are? Or do they not count at all and is she simply without income?

3/ Also, if she needs to be a sponsor also, how many people need to be on her stepfather's sponsorship form, i.e. who is in the household that her stepfather needs to support? Only me, or my fiancee also?

4/ I've read that the I134 needs to be notarized, what does that mean exactly? Since my fiancee lives on the west coast and her stepfather on the east coast, does that mean I'll end up paying for that service twice?

And finally ...

5/ Anyone else gotten into special trouble during their interview or any time in the process because their US fiancee was a student or poor?

Your fiancee is the primary sponsor. She can show her occupation as student with no income. The step-father is the co-sponsor, providing a separate I-134. His household is numbered as the people living with him and dependant on him for support, plus you. Your fiancee doesn't count on his form unless she's dependant on him for her support.

Notarization is required but generally free one's own bank or insurance agency. Lot's of poor students bring their fiance from abroad without problems.

Facts are cheap...knowing how to use them is precious...

good day VJ.! can i ask about this forum too? although i am not the one who is involve but just want to help my friend regarding this matter. she (beneficiary) and her bf (sponsor) are planning to file K1 visa. her bf will have a co-sponsor which is his mother. my question is, they just haven't met since they had a relationship. and as far a i know, meeting in person within two years is required and pictures.. do they have any way to do about this since they havent met yet? pls advice about this. it will be a good help. thanks very much!

This question isn't even remotely similar to the inital question. You should start a new thread with this question. I'm not saying this to be mean, but your question might not be read as much if you post in someone else's thread.

The short answer is: most likely your friend will not be able to get an approved K1 visa if they haven't met in the last 2 years. USCIS is pretty strict on this unless there are extreme circumstances.
