Missing Cards

After the successful AOS, my wife and daughter never received their green cards. After following up with immigration, they sent a letter, stating that they sent the cards, and therefore, the cards must have been lost in the mail. Since they were "lost or destroyed", I am stuck with paying $740 for two replacement cards.

Why do I need to pay? The post office is part of the government. It is the government that screwed up as usual, and failed to deliver the cards. I have been at my address for 30 years, and never had any mail lost during that time.

In my opinion, either USCIS never produced the cards, never mailed them, or someone is using the blank cards to make cards for someone else, at our expense.

Is there anyone I can complain to? Reading in the forum, I am not the only one that this has happened to.

Did you move after filing the I-485?? If you did and did not report the move, then USCIS may have sent the cards to old address.

Note: Mail from USCIS is NOT forwarded, it is returned to USCIS.

Filing Fee if you are filing because:

• You never received your Permanent Resident Card; or
• Your Permanent Resident Card was issued with incorrect information because of a USCIS administrative error;

Then there is no fee required. Please review the Where to File Instructions, below, if you are filing for these reasons. Total filing fee = $0.

There is NO fee if cards were never received, however good luck proving that they were lost in the mail.

Doesn't look like the OP moved recently.

Why did you wait so long to pursue the missing cards? It might have been easier to prove you never received them if you had tried sooner.

Good luck getting them replaced. I hope you don't have to pay.

From your timeline, it looks like the biometrics appt also never arrived. That could show a pattern, maybe if you cite that instance, it would help your get them without paying.

Nope you will have to pay for new cards. They will only replace them free if they were returned to USCIS as undeliverable. If they have been lost in the mail then it is not USCIS issue, as far as they are concerned the cards were issued. You would have to sue the post office for non delivery. but I guess you would be cheaper paying for the new cards.

You also need to make sure that your full name is on your mailbox where the mail person can clearly see it.

You would actually expect them to make an appointment with you to pick it up. In my home country you would never receive government ID's in mail. They call or mail you to pick it up (e.g. post office) and most importantly you have to sign for it before you get it. I can imagine that USCIS offices are not around the corner to everyone but a post office should be within reach.

My wife and I had very close to the same thing. Except they sent the card to our old address of 3 years ago. They sent the welcome letter to our new address but sent the card three times to the old one. Finaly after we got it, it had the wrong name on it. Her maiden name was on it and from the 130 and 129F it all the paper work was in her new married name. Now they want us to pay liek $340 to change her name and get it strait for their mess up. Actually the last time that they sent it to our address it was sent in her maiden name and it was undeliverable, because no one in that house has that name. Just her married name...HMMMM.

It's amazing how stupid these employees are. Do they not have any accountability there? Is there anybody overseeing these Einstein's?

And then they try to charge us for their fu**-ups.
