USCIS PEAKS INTO FACEBOOK

The open forum comment that seemed to create the most chatter during the conference was when USCIS and the U.S. Department of Labor (DOL) both noted that they look to sources of information that are independent of the record established by a petition and its supporting documentation to verify the information contained therein. What this means is that the agencies now look to public information that is available on the web that concerns, for example, the finances or business operations of a sponsoring employer to determine whether that employer is, in fact, offering bona fide employment to a nonimmigrant worker.

Or, keeping this article about the beneficiaries, USCIS explained that it often searches through Myspace and Facebook, prior to marriage-based adjustment interviews, to see what the couple may be discussing with each other and their contacts and whether they entered into a bona fide marriage. In response to the murmur of objection that began to build throughout the room despite a relatively recent New York Times article that noted employers have been doing the same for quite some time, USCIS analogized its position to that of a bank that inquires into the financial viability of a prospective borrower. I am not so horrified by the idea of government agencies accessing information that people have themselves made available to the general public, depending, of course, on whether USCIS is accessing private profiles through agreements with these online social network providers. However, this analogy does highlight the USCIS mission as one that is primarily oriented around enforcement rather than the impartial adjudication of an established record, and justifies concerns that petitions could be denied for undisclosed reasons.

That's why they warn you about been careful about what information you put on those networks. I've heard about employers screening potential employees on Myspace and Facebook and the likes. Interesting to know that USCIS is looking into it too...

I actually met my fiance on myspace ha ha

I have nothing to hide and would even give the Embassy my password so they could check our relationship was legit, if they want to go through 2 years of e-mails then fine by me if it speeds up the process.

Well we didn't meet on MySpace but close enough, infact I would love it if they looked at my Facebook. At least it says we're engaged, everyone has left congratulation posts, and there is a Janka and Jeremy folder with like 55 photos. Soooo, totally work in my favour lol.

Oh wow... very interesting. Thanks for sharing! I thought only potential employers would peek into MySpace/Facebook etc, didn't know that the USCIS employees have this much time on hand to social network! LOL. :star:

There would probably be something in the terms & conditions that allows facebook/myspace to give your details to third partys. USCIS being a government department will probably have quite an influence.

There is always a loophole.

First off, how they will find your email address?? At least while filling IR-1 visa, I haven't put mine or my husband's email address anywhere in the forms.

Now with Name search on my space or face book, my husband's name is Joe, and I do think there will be thousand other Joe's out there??

May be they do read these family immigration boards, can find a lot from here.

lol They are the government, they can find anything. While pretending to work at work, I read through the terms and conditions of facebook. It's in there. They can view your stuff.
