Ok, I have another question about EAD.

I have been waiting for EAD and AP for over 80days.

I have no RFE and no hold.

I kept calling up USCIS. Now, today, some lady told me that I have to wait for another 3months. It seems that this lady had no idea what she was talking about.

EAD and AP are different from AOS. They should be approved withing 90days.

She looked at the local office processing time. Ok, lady, the local offices do not process EAD anymore.

NBC processes EAD and AP.

I am planning to make infopass next week. Does it really work?

Some customer service reps say I should do service request.

Did anyone try ?

06/19/2008 POE at LAX with K1 visa

06/28/2008 Married my husband

07/03/2008 Update my social security card

07/19/2008 AOS, EAD, AP mailed to Chicago lock box

07/21/2008 AOS, EAD, AP were received

07/28/2008 NOA1 for AOS, EAD, AP

08/04/2008 Biometric appointment letter arrived

08/15/2008 Biometric at Santa Ana office

10/21/2008 No update since biometric- contacted a local congressman, the ombudsman

10/22/2008 Was able to do service request

10/23/2008 EAD was approved

10/24/2008 AOS interview letter arrived

11/26/2008 Renew my State ID

12/10/2008 AOS interview approved right away

Does an InfoPass work? Yes... you'll have a face-to-face meeting with a live person.

P.S.,

There is no hard and fast rule that AP nor EAD must be approved within 90 days - it is an estimate. Hang in there. :thumbs:

there is for EAD... it is printed right on the instruction for the I-765:

"Interim EAD. If you have not received a decision within

90 days of receipt by USCIS of a properly filed EAD

application or within 30 days of a properly filed initial EAD

application based on an asylum application filed on or after

January 4, 1995, you may obtain interim work authorization

by appearing in person at your local USCIS District Office.

You must bring proof of identity and any notices that you have

received from USCIS in connection with your application for

employment authorization"

in some place on USCIS web site it says "do not wait after 90 days, just make an InfoPass appointment for the Interim EAD"

The local offices don't issue iterim EADs anymore, they stopped in 2006. All they can do is call NBC and inquire about your case, which is good, I think it helped me, my EAD was approved 9 days after my infopass (date on a card is Aug 9).

Ya, that's what I heard. Local offices can do service request, but they cannot issue EADs.

I also have heard that contacting local congressmen or women will help because they have a lot of power over USCIS.

My husband tried to do that when our K1 visa was absolutely out of processing time. The congressman's office has a special form of the immigration and his office can do investigate our case immediately.

I know how frustrated you are, but I suggest waiting another week or so. I was also one of the people who got left behind when people who had applied after me were being approved. But as you can see in my signature, my EAD did finally get approved and within 90 days of NOA1.

I know how frustrated you are, but I suggest waiting another week or so. I was also one of the people who got left behind when people who had applied after me were being approved. But as you can see in my signature, my EAD did finally get approved and within 90 days of NOA1.

I sent my application (I-765 and I-4850 on April 25, 2008. It is 10/11/2008 today. I have not received any updates jet. The USCIS web site shows that my case is still pending. I wonder if there is some one else out there that filed at the same time as I did and still has not received anything? I tried to make InfoPass apointemnt via the USCIS web site, but my local office in Charlotte NC does not have any appointments available:

""At this time, there are no information appointments available for the office in your area. Please try back again later. "

What sould I do? :unsure: I highly appritiate any of your help!

The USCIS website clearly states that you should call customer service immediately if your EAD has not been approved within 90days. It is called service request. They will investigate your case.

Did you get RFE?

Definitely, call customer service.

our biometric was on July 25th, so it's been 90 days since...urgh.

06/20/2008 -- After the sad passing of my girlfriend's father, we decided to get married and stay together

08/08/2008 --- We get married, lovely ceremony and dinner with all of Sarah's family present :-)

08/25/2008 --- AOS package sent to Chicago via Fedex overnight priority mail. Fingers crossed now!

08/26/2008 -- AOS Package received in Chicago, signed for by A.Smith (1 day before my VWP expires!)

09/02/2008 -- Checks cashed!!

09/03/2008 -- NOA1 received for I-485, I-130 and I-765.

09/05/2008 -- Case is shown online as pending!!

09/08/2008 -- Biometrics appointment letter received for September 23rd!! (For both I-485 and I-765)

09/12/2008 -- Biometrics walk-in completed, 11 days before the appointment! In Hackensack NJ.

09/20/2008 -- RFE for I-485 received. It was dated September 17.

Infopass is for you to be able to meet with an immigration officer at your local office if you have question about your case, such as your EAD application had passed 90 days and you haven't received any updates from USCIS yet and so they will make a service request like emailing the NBC at missouri. If you have problems with your case that you want them to answer (although sometimes or most of the time it was not answered). Anything about your case that you can't confirm through the USCIS Customer Service phoneline (sometimes they can't confirm it too with the local office). And most importantly, in my case, just to ease my anxiety, knowing that ive done my part on asking what is happening with my case :wacko: I don't think it will delay your case or it will waste their time when we inquire, since that's what they are supposed to be doing anyways. But of course try not to argue with them... :blush::whistle:

Infopass works!!!!! I had it on Oct 27th and today my I-765 is available online (wasn`t before) and its status says "card production has been ordered"!!!! :dance:

I recommend to everyone who has been waiting more than 90 days for EAD !!!!! :thumbs:

I made an appointment for Nov 13th, hope that the EAD arrives before that. Curiously, on USCIS website it says that they received the application on July 3rd and that they mailed us the notice describing how they will process it - we never received any correspondence pertaining to EAD or Green Card.

But ok. At least they are working on it.
