Marilyn and I were married in Aug of 2004 and AOS finally approved March 25th 2005. So we will be applying in Jan 2007.

K-1 Timeline in Profile (our story)

Church wedding Sept 18

NOA1's for AOS/EAD received Sept 20 MSC #

Biometrics completed Nov 5 2004

EAD Approval Dec 29 2004

AOS appointment letter received Feb 3 2005

AOS interview scheduled for March 9 2005

AOS interview mostly fine, just need I-693 supplement filled out by civil surgeon

Spend another $40 for I-693 form, sent to local USCIS office registered mail, arrived March 11 2005

AOS finally approved March 25th 2005

Green card arrives about 10 days later

!!Green card has incorrect middle name!! Thanks USCIS

Travel back to Denver, turn in card and I-90 to correct their mistake.

Application accepted, asked for I-551 stamp, they told me "We don't do stamps anymore"

NOA1 for I-90 received from NSC April 18 2005, fee waived

NSC appears to have stoped processing I-90's

Marilyn needs to travel back to the RP, call Senators office for help with green card or I-551 stamp

Travel back to Denver July 1, 2005 and received I-551 stamp in the passport.

The wife and I were married in March 2004. My wife's successful AoS interview was in February 2005. For some odd reason my (then 19 year old) stepdaughter's AoS interview was scheduled on a different date in March 2005. So I will be filing my wife's I-751 in November of this year and my stepdaughter's I-751 in December.

I *think* that because your wife's and stepdaughter's green cards were granted less than 90 days apart, your stepdaughter can be included on your wife's I-751. If I were you I'd check that out--you may very well save the $205.

It's only if hers were granted more than 90 days after your wife's that she'd need a separate application.

If your child received conditional resident status within 90 days of when you did, then your child may be included in your application to remove the conditions on permanent residence. Your child must file a separate application if your child received conditional resident status more than 90 days after you did.

I vaguely remember reading something along those lines somewhere. As I said, I have taken a vacation from the US-CIS since AoS, but it will soon be over in the next few months. Thanks for the link. :thumbs:

I never understood why my wife, stepdaughter, and I did not interview on the same day. I filed their AoS paperwork in the same envelope and even paid for both with one check. Even the adjudicator at my wife's interview didn't know, but told us she has seen it both ways (separate and together). I thought it was because she was older than 18. My stepdaughter will be 21 years old when we file the I-751, but I don't think that will be a problem. She arrived in the USA at 18 years old as a K-2 on the same day as her mom.

Timeline

We were married in Feb 2004, moved to Florida shortly after and went through a few crazy trips to Colorado when BCIS's computers didn't update our request to move our application/file to Miami. Which in a way was a good thing because we got our interview date within 7 months of applying!

I just sent in my I-751 application about a week ago and received one of those 797C notices to go get fingerprinted in 10 days. Eeeks .. to think this will finally be over soon. :dance:

as you can see in our timeline, we got married in march 04. we went with dcf and the consulat in frankfurt, germany. by july I had my visa and in august I moved to CA.

I just filed for I-751, but I got the package back with a note, that I don´t have conditional status. I have no idea why. since my passport has a august 3, 2006 expiration stamp (but I have a 10yr. green card), I´m wondering if I should keep a copy of that note in my passport, since I´m planning on visiting germany in september... I don´t want to get stuck at the airport when I try to reenter the USA.

any ideas?

March 25-04 - very happily married in secrecy

March 31-04 - sent I-130 to Frankfurt (DCF) via certified mail

April 06-04 - ordered new ID & passport

April 10-04 - received RFE … aaaaaarrrrrrghh....

April 15-04 - mailed I-130 package again

April 26-04 - Consulate cashed check

April 30-04 - immunity blood test

May 04-04 - new ID & passport received

May 07-04 - results from blood test => need only TD *yippie!*

May 11-04 - TDP-shots received *ouch*

June 25-04 - "packet 3" received!!! yeehaa

June 28-04 - packet 3 express mailed back

July 05-04 - Fred´s birthday :o( - but packet 4 arrived!!! :o)

July 21-04 - medical

July 22-04 - Interview - approved... *yes*

July 24-04 - Passport with Visa in mailbox :o)

Aug 03-04 - on a plane to CA :o)

I had my Green Crad after about 4 weeks. Never got my Social Security #, had to apply again at the local office.

June 17-06 - I-751 to remove conditional status filed

July 20-06 - package returned with note, that I don´t have conditional status and therefore, there is no need

to file an I-751... great! :o)

hi, that is sort of strange, but you did the right thing.

You married in Mar04, immigrated in Aug04. You should have been admitted as class CR-1 (with conditions) since you were married for less than 2 years when you got your PR status.

The passport stamp is always only good for one year.

You got a ten year card because you were admitted as class IR-1 in error, and you did the correct thing by filing I-751 anyway (from the lawyer's advice I have read given to others in the same boat). I've not heard of your outcome happening before.

If I were you, I would make an InfoPass appointment before travelling in September and get your District Office to straighten your record out. They should also provide you with a passport stamp at that time (if you ask) so that you are covered for travel if something changes in your record while you are away. You should be able to refile your I-751.

To the OP, I'm sorry things didn't work out for you Karen.

We were married in Sept. 2004 and my husband got his greencard Feb. 2005, so we'll be lifting conditions this November. I'm sorry to say I haven't been as vigilant about collecting evidence for this step as I was for the Visa and the GC.

Thanks for this thread, it reminds me that I have to get my heiny in gear!
