Generally speaking, if you've been married 2 years or more at the time of the interview you will be issued an IR-1. However regardless of which visa is issued, its whether you've been married for 2 years at the time of US entry that matters. Keep in mind that it is always possible that details will be overlooked, so if you're issued a CR-1 visa but qualify for IR-1 at the time of entry, have your marriage certificate handy to point out your marriage date to the POE officer to be sure you'll be issued the correct greencard.

Did they say why it took so long to schedule interview? I am trying to get my hsuband's case completed by middle of November as he has to update his passport. Do they really take that long to schedule interviews?

Be careful with that, I updated that information with NVC because we had been married longer than 2 years. When my husband interview this past Monday, he got a 221(g) on it states CR1 not IR1. So I contacted the Embassy about this issue, they stated in their records its states CR1 not IR1 because the time we were approved at USCIS we were yet not married 2 years.

So I had to send them Documentation from NVC indicting this change because they would not do it. They confirmed that they would NOW change it to IR1 since NVC had done this. So please confirm with your Embassy before assuming you will be issued an IR1 at POE.

I just wanted to ask, when we filed for our I-130 petition, we were married for 3.5 years and now by the time our interview will be scheduled it will be a little over 4 years. So do we automatically get IR-1 during interview or it happens at POE?

Our AOS and IV bill barcode page states as IR-1 visa.

Thanks for all the feedback.

I agree with all said, one can never be too sure with the Guyana Embassy.

MrsRowe the embassy gave no explanations. The NVC said it the embassy, and the embassy said the NVC assigns.

I think the major problem is the volume at the Embassy compared with staff. i think the embassy possible processes 5000+ cases per year.

Will keep all updated.
