Guys...

Help.

So I'm waiting for the Civil Surgeon from Texas to send back all my stuff and I'm just going over everything for AOS.

I JUST noticed on our marriage certificate, it says that Nick was born in Jersey City, New Jersey. He was born in Secaucus, New Jersey.

Do I have to get this change on the marriage certificate???

I'm so upset.....

This will put us back weeks.....

How does the USC's birth certificate "play" in your AOS application?

I have to fill it in on the G-325A and on that it asks for Nick's place of birth.

If I put Secaucus...and our marriage certificate says Jersey city.......

Read again... The I-485 is your application, not his... No G-325a is required from the USC for your application

fwaguy is right....you only submit G-325A for yourself. AOS is your petition...the USC spouse is involved in the I-864 process, the financial support portion. Otherwise its all about you, the foreign spouse, who w/ the I-485 are petitioning to adjust your status to resident.

But on MY G-325a it asks for HIS place of birth because he is my husband!

and on our marriage certificate which we have to include, it says his place of birth is Jersey City!

He was born in Secaucus and the G-325A that he submitted before, it has Secaucus.

HI there sorry you had this mistake..If you want to make things right..it will push your AOS application a little but at least you can have it fix right..On where you guys applied for the marriage certificate Im sure they will make some corrections for that especially its their mistake. You are worried about nothing... Do you really believe they will look at his previous G-325A?

So on my new G-325A, I should put what...Secaucus or Jersey City....?

Who knows if they will look at that and then the certificate and go..."hmm"?

I guess I'm worried for nothing...sorry.

I suggest you send it as is, but then get it fixed, so if an RFE does come later, you will already have the new marriage certificate in hand and will be able to reply to the RFE right away.

Chances are VERY GOOD that they won't even notice the slight difference.

I doubt they would even notice...but for your own piece of mind....submit all your documents as is. In the meantime, contact the clerk's office in the county you were married and see about correcting the marriage certificate and getting a copy of that. This way you have it available should they by some miracle notice the discrepancy and you can send it in to them as soon as you receive the RFE in the mail. At the most it will delay you 1-2 weeks. ( And you can rest easy that your marriage certificate has all correct info on it.) But I highly doubt you'll need it.

Put the city(suburb) where your husband was actually born....what is reflected on his BC, forget what is written on the marriage certificate.

Yeah, except that the G-325A asks for information about your husband or wife, and one of the things it asks is for the city and country of birth of the husband or wife (I just looked because I did not remember if it asked this or not).

I think I'd just put where he really was born on the form and include a note explaining that there was an error on the marriage certificate in his birthplace and it will take several weeks to get it corrected and order another copy. It still shows that you are legally married, which is what they are looking for. If they give you an RFE for it, you will have the corrected certificate by the time they send it, so it would mean less delay than if you wait to file until you get it corrected.

Although actually, the first thing you might want to do is go to the county clerk's office that issued your marriage certificate in person and see if they will correct the error and give you a new certified copy right then and there. If they do, you are all set.
