I sent the new form in for the EAD for my wife and daughter. I wrote in "no" for the answer to question 11. It seemed to be correct. My wife got her notice for the EAD and it was accepted. But I have a new problem. I also sent in an I-765 for our daugther. It was rejected again. This time because of incorrect filing fee, they want $340 more.. I paid $1010 for my wife and $600 for our daugther. I sent in a copy of the NOA for the I-485 which was accepted. I don't think I need to pay any more. Or am I missing something? Our daughter is 4.

Why would a daughter aged 4 require an EAD?

Hi! I resent my I-765 on Sept 4. I also answered "no" at that question and I was stressed that I didn't get NOA yet, but now I feel better because I see your wife's didn't get rejected again...Good luck with everything

HI, I just got the NOA for the I-765. happy about it, and also I got another biometrics appointment for the I-765 although I did one for I-485. I didn't know I had to go 2 times I thought one was enough. Did everyone go through that?

From the USCIS website (immigration forms> form updates, on the right hand side of page):

August 18, 2008

*

USCIS reminds customers to use correct edition of Form I-765 to Request Employment Authorization.

*

The correct version of the Application for Employment Authorization (Form I-765) is dated 05/27/08.

*

Submission of an earlier version of Form I-765 may result in rejection of the application..

the one dated 05/27/08 is the one I filed and I got my NOA1 for it (I downloaded it before the 31st). I think they mean that the previous edition expired on aug 31, 2008.

If your 765 was "REJECTED", you will check "NO" to the question about whether you have applied before. The only time you would check "YES" would be if your application was adjudicated (approved or denied). If they simply reject it, it doesn't count as a submission.

The current form is expired, but they haven't put up a newer one, so that's the one people have to use.

Dated 5/27/08

Exp 8/31/08

We got a rejection notice today for the I-765 EAD I sent in. They said the form I used was outdated. I read posts from others that had the same problem. I downloaded the newer form. Now, my question is on question 11 "Have you ever before applied for employment authorization from USCIS?". Is the answer now YES?

How is your AOS going. Any touches, transfered to CSC by any chance? If so, you might consider not to file for EAD afterall.

I'm glad that you've posted this issue...I just want to make sure that if I'm filing all my forms there should be no problem...the I-765 newer version is 05/27/08 but at the top hand corner it expired already 08/31/08. How come USCIS didn't change anything about the expiration date? If some USCIS personnel who is working on applicants papers and not aware of the revision date and they're only looking for the expiration date...indeed they will definitely deny the application for EAD because of that expiration date. Lucky those applicants who got approval for their EAD..probably those personnels were aware about the revision date..how about those who were not aware? what will happen is .....they will keep sending you a rejection letter due to outdated form and you as an applicant who badly really wanted to have your EAD soon 'coz it's really tired to stay at home ...you kept sending new application for EAD because they asked for it.... what do you think guys, huh?

"Have faith in God, Jesus answered. I'll tell you the truth. if anyone says to this mountain, Go, throw yourself to the sea, and that does not doubt in his heart but believes that what he says will happen. it will be done for him. Therefore I'll tell you, whatever you ask for in prayer, believe that you have received it, and it will be yours" (MARK 11:22-24)
