Hello guys, got some questions here. My fiancee in the philippines has a record of getting her visa canceled by US immigration in san francisco. Here's the story. My fiancee and her sister came to US in a visitors visa. Here sister was denied to enter US due to immigration found out that my fiancee sister work in the US 6 months before she reenter again with a visitors visa. That was my fiancee first travel to US. They banned my fiancee sister for 5 years and they told my fiancee to withdraw her visa application and so there is a canceled stamp in my fiancee passport. My question is, is that a problem in getting my fiancee to come here is US so that we can get married. Please advice.

Not the best way to start a visa journey!! At the same time "good things don't come easy"! :bonk:

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You would be in good shape to consult an good immigration attorney in a case like this. It could cost a little money, but even just a consultation should give you the info you need to know the best way to proceed. You might just have to fill out some information differently than usual on a few forms, but hopefully not much more than that...

Filed I-130 via CSC in Feb 2008. Petition approved June 2008. Consular interview in Mexico, Oct 2008, visa denied, INA 212a6cii. We allege improper application of the law in this case.

2012, started over in Seoul: I-130 filed DCF on 7/2, I-130 approved 8/8, Medical at Yonsei Severance 11/20, IR1 appointment in November 2012.

GREAT advice from Guatetaliana.

While there are many of us that know way more about the US Visa process than we would like to,

we are not attorneys, and most of us only know how the process works when everything is near perfect.

If I can speak for the community...most of the time an attorney can be a waste of time and possibly slow the process,

but in your case, I think at least a consultation will be money well spent.

I may be wrong but it sounds to me like they just deny entry to her and reading the forum it happens often but never give problems on getting a Fiancee Visa...Even if they put the stamp on the Visa she had, they didn't banned her from the country so I don't think she will have problems. This is my opinion..but a lawyer would know better!

If you were marrying her sister you'd have a problem, but you are not. There shouldn't be any issue for your fiancee.

Being allowed to withdraw her petition to enter is completely different from being denied entry.

It sounds like they cancelled her B visa, that's all. As john and marlene stated, if you were marrying the sister (who has an overstay/ban) then you would face the waiver to overcome the ban but just being turned back is not cause for alarm in most cases.

Of course, you will need to be absolutely sure there is no other stamp in her passport but this will be a non issue for the K1. It happens to the VWP travellers too. ;)
