How long to citizenship after K-1 marriage?

Timeline

I know that it's 3 years to citizenship for a spouse of a citizen, but when does the counting start after a K-1 marriage?

The initial green card is only temporary, so does that count or is it 3 year from the permanent green card which would take at least 2 years?

Start count after the you get your temporary green card. 2 years (conditional) plus 3 years after living in the US, so technically lets say you get your temporary green card today (must satisfy to remove your conditons in 2yrs), in 3 years you can apply for USC.

Under N-400 application it states as the 2nd option:

Who May File Form N-400?

"2. A Lawful Permanent Resident for at least three years and at least 18 years old,

AND You have been married to and living with the same U.S. citizen for the last three years,

AND Your spouse has been a U.S. citizen for the last three years."

This would pertain to K1-K3 visas.

When you receive 2 year conditional green card, you can check "resident since" date.

That's start date to count citizenship application eligibility date.

When you reach to 90 days prior to 3 year anniversary date and keep marriage life with same US citizen for same period, you can apply for US citizenship.

But you have to keep the marrage until the end of whole process.

Otherwise you can apply for US citizenship when you reach 90 days prior to 5 year's anniversary date from "resident since" date if you meet certain residency condition such as...

1) Half of the period, you should reside in U.S.

2) No single trip more than 6 month out of U.S.

3) At least, you should live more than 90 days in the place when you apply for N400.

So here I am once again and after much reading ............ #1 Do we file for the I-751 and file the and the N-400 for naturalization at the same time ? Here on K-1 and the 90 day mark will be in June of 2008.

June seems so far away but I know better .

Look at the expiration date on your conditional green card. One year from that date, you can become a citizen.

Guess what I need to know now, can we file both the I-751 and the N-400 at the same time ......... seems to me I seen that someplace on here but just can't find it and her card expires in September of '09 and I thought that we can file for both at the same time,since the N-400 might take up to a year ??

You can file the I-751 during the application window (90 days prior to expiry).

You can file the N-400 at anytime after the application window opens (90 days prior to qualification, 3rd anniversary of PR status for most)

For most if not all the applicants the windows are about 1 year apart.

You do not have to wait for the I-751 to be approved. If the N-400 application window opens you can apply.

No. Three years is not the same as two years.

From your signature, it looks like you got conditional LPR status on 8/23/07. If that's true, you need to file your I-751 sometime between 5/25/09 and 8/23/09. The earliest you could be eligible to file an N-400 would be 5/25/10, and if they finished your paperwork quickly, you could be eligible to take the citizenship oath as early as 8/23/10.

I'm assuming you remain married the entire time, you meet all the naturalization requirements and don't have any other issues about eligibility, and you're filing for naturalization under the "three years married to a US Citizen" shortcut, not any shortcut available only to military service or other extraordinary circumstances.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Very interesting topic!

But I'm a little bit confused here. I also had a K-1 visa and my Green Card (it's the first one) states that I'm resident since 07/15/07 and that the the card expires in 07/15/09.

I'll have to send the papers to renew it about 90 days before the expiration date, right?

So, when exactly I can apply for the citizenship? In 07/15/2010 ???
