K3 is getting divorced without a green card..

Hey guys! I have a question for you.. So the situation is the following..

My friend and her husband met somewhere in Georgia( the country ), got married in Russia, she's Russian, he is from the States. So she got all the papers done in Russia and came here 3 weeks ago. Now her husband decided to divorce her all of a sudden, she cant get a ssn or a green card, she only has a state ID (AZ). What can she do about it? Any advice? She doesnt really wanna go home,'cause she's scared that people will judge her, and its such a shame for her.

I would appreciate any help, she's so lost right now!

Why are you providing a link to filing as an abused spouse, when that was definitely not mentioned by the OP? Filing under VAWA is serious stuff, and not a means to just get a GC. If the husband had a change of mind, and decided he no longer wishes to be married, the Russian girl is out of luck.

They should have filed for AOS as soon as she got in the US. Having only a state ID doesn't mean anything. Perhaps he wasn't sure of her intention/her love, and wanted to test it out (not very nice) and hence didn't go through with AOS. The guy filing for divorce after only 3 weeks of being together in the US seems like he was real unhappy.

Technically, as a K3 holder, she has 30 days after the divorce to leave the country or she will be out of status.

I think that's why the husband filed for divorce so quickly. He checked into it, and may have filed so she would not attain status here.

It seems that so many marriages are falling apart regardless of who is at fault. People usually have good intentions to begin with but uscis may start analyzing this and consider them fraudulent marriages slowing the process down for everyone.

Technically, as a K3 holder, she has 30 days after the divorce to leave the country or she will be out of status.

Correct answer. The Russian woman doesn't want to hear this but correct it is.

Hindsight can only help others but this is another reason for sticking with an immigrant visa. If it were CR1, she'd only need to show she entered the marriage in good faith. With K3, she goes home.

i think her husband can't file a divorce case at early stage of marriage...unless they're both US citizen.

Anyone can file for a divorce whenever they want, regardless of status.
