Hi community I am 26 year old single birth place India citizenship Indian. I have done my schooling and bachelors from Delhi. But two years back I met with a 23 year old Indian girl in India and we falling in love with each other. She is a US passport holder but she was already married two month back when we met and she returned to US again. We used to talk over the phone 3-4 hours a day. Now she has filled divorce form and telling me that the divorce process will be completed with in 4 months. Now we are planning to marriage in India when she will come after her divorce. So friends my quarry is should it help to get visa after marriage or we will do engagement (ring ceremony) and apply for the fiancé visa. Which process will be the quickest and easy? Plz help thanks

You are asking about a applying for a visa, not about adjusting status from a NON-immigrant visa.

If you are marrying overseas, then you wont be doing a K-1 fiancee visa, you will be doing a CR-1 or K-3 spousal visa.

Correct, but the OP stated getting married in India.

No the OP mentioned either getting married (spousal visa) or getting engaged (fiance visa) and hadn't yet decided which way to go.

The K-1 visa is faster in most cases but not always.

So I think the OP has a basic understanding of the differences..

Fiance visa is quicker if for no other reason that you can file as soon as the divorce is final instead of waiting until after arranging travel and marriage. With a very recent divorce, however it may not be "easiest" in terms of success.

The fastest way would be a CR-1 visa (spousal visa) via DCF, but that would require your wife to stay and be resident in India for some time after the wedding, usually 6 months.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

I guess it depends on where you start counting time. In this couple's case, I'd start counting from the divorce final date.

thanks sir u have devoted lot of time for me. thanks a ton but sir she already filed the divorce paper n will be free after 3 months according to the lawyer. n what i understand k3 is best in my case according to u.... thanks
