We are about to file our AOS but I was wondering if it's faster to get the EAD if you file it before filing the AOS? The speeed is more important than the money as we need to get a social security card and they won't give that without an EAD.

I have heard of some people getting a social security card without an EAD...anyone know about that. OUr SSA would not budge.

I doubt your spouse would be able to get a SSN if she is out of status. However, I see your spouse entered in June, so the I-94 is still valid for a couple of months so you shouldn't have any problems getting the SSN. I entered the USA on a K1 and applied for my SSN a couple of weeks after and this was granted because my I-94 was still valid for over 2 months, plus the K1 gave me employment authorization for the duration of my I-94, (3 months).

There used to be a PDF file of an internal memo to localized SSA offices on here somewhere detailing that people in our situation are free to work for the 90 day duration after entering on a K1/K3 visa but I can't locate it at the moment. Originally I was sent away when I went to my local SS office, but returned the same time armed with the memo and then the officer actually admitted the error and processed me.

I have a specific question: What do I put on the AOS paperwork for my name? I'm changing it on all of my official documents also next week since I'm on vacation for a month (summer holidays).

Just got our NOA1 in the mail today for our AP, AOS, and EAD.

It looks like our local office is Dallas, which appears to be the worst possible office and the timelines have me feeling a bit hysterical.

Can someone give me a clearer picture of the timelines we can expect? I thought I understood this process but I obviously have misunderstood quite a bit.

I thought the EAD application was for a 90 day EAD to tide us over (approximately) until our temporary green card was issued. Then after the 2 year temporary green card is up, the Removal of Conditions we presumably filed nears and we prove (yet again) that our marriage is legit, etc etc, and we get a 10 year green card.

The timelines, however, state that it's an average of 222 days before our interview, aka temporary green card?? Does that mean that I am supposed to prep for almost a year of not being able to work? #######?

Obviously a 90 day EAD is going to do diddly squat and doesn't make sense to constantly be bleeding money for repeated EAD requests that will arrive at unpredictable intervals.

I would really appreciate someone clarifying all this, before I have a conniption. I feel sick.

Nope. The temp 90-day EAD refers to the stamp that some people get at POE. It's considered good for 90 days because it's good for the 90 days your K visa is good for. The EAD you have applied for along with AOS is good for until you have the green card. So you could get that EAD at about 60-90 days, and work on it, while it might take a year or whatever for the green card to come. If you were lucky enough to get the temp one at the border, then you could work now. Then if your EAD (that you applied for with AOS) comes before the 90 days is up, you are good to continue working. If not, and it takes longer than 90 days to come, you would have to stop working, wait for the EAD to be approved, then work again. I hope I didn't confuse you further. :blush:

We had some good news today and got our NOA1s. They are dated July 7. I had been getting a bit worried seeing other people's get theirs quicker and not seeing anything show up in the mail, so I was quite happy to see them today. I really like being able to check our case status online again. :) We also got our biometrics appointment letter. It's for July 25th, which sucks because we'll be in Las Vegas at my friend's wedding. Hopefully it won't be a giant pain in the ####### to get that rescheduled.

So the EAD I applied for in conjunction with my AOS package was the C9 type, which is good for 1 year, during which the wheels of my green card are in motion, and then when my green card arrives, I apply to lift conditions once we've been married for 2 years, at which point I get a 10 year green card, is that correct?

I'm not working at the moment despite having a valid I-94 with my K-1 and was able to get a SSN with no problem, as I entered the US on May 18th and wasn't able to file for AOS until the beginning of this month. I knew that there was little chance of my EAD coming in before the I-94 expired even if I had applied right away, and didn't want to start a job only to have to quit a few months in and try to get re-hired due to the gaps in work authorization. I thought it would look bad on my resume, y'know?

Another point of confusion is what status I will have once my K-1 expires. Presumably I won't be here illegally as I've already filed for AOS, but will no longer be a K-1; what exactly are we post-NOA1 AOSers? :unsure:

I'm not sure about C9 -- I'm just not familiar with that, but you could totally be right -- but yes, it's good for one year. In the (unlikely?) event that your green card takes more than a year to come, you can apply for another EAD for another year. And then, yes on the other stuff, as far as I know.

I'm not sure what the status would be called (someone here knows I'm sure), but not illegal as long as you're married.

Oooh, I just logged on here to update my signature timeline as the check was cashed recently while my wife went outside to pick up the mail. Yay, in the mail today was my NOA's for both my I-485 and my I-765!!

03/14/08 K1 Visa Received

03/17/08 Entered USA on Visa

06/04/08 Wedding

I-485 AOS Timeline

07/02/08 I-485 Package sent to Chicago Lockbox with I-765 Employment Application. (Received 5th)

07/11/08 Check cashed

07/10/08 I-797C NOA's sent for both I-485 and I-765 (Received on 15th)

07/17/08 I-797C Biometrics appointment letter sent (Received on 21st)

08/02/08 Biometrics appointment in Denver, Colorado.

09/05/08 EAD Approved

09/09/08 EAD Card Production Ordered

09/10/08 EAD Card issued (Received 15th)

10/24/08 Interview Letter Received

12/08/08 INTERVIEW - APPROVED

12/08/08 2 Year Permanent Resident Card sent, (Received 14th)

I-751 Removal of Conditions Timeline

10/04/10 I-751 Package sent to California Service Center (Delivered 6th Oct. @ 9:25am)

10/06/10 I-751 NOA1 issued, (received 14th Oct.)

11/29/10 Biometrics Appointment (Received letter 8th Nov, dated 1st Nov.)

02/03/11 APPROVED - 10 Year Green-Card production ordered.

02/14/11 10 Year Green card received in mail.

N-400 Application for Naturalization

12-22-17 N-400 package sent in Phoenix Lock Box
12-27-17 Package received at Phoenix Lock Box and I-797 NOA sent to me.
01-17-18 Biometrics Appointment in Denver, CO (I missed this as no appointment letter was received.)
03-22-18 I found out about missed appointment and contacted USCIS to reschedule.
05-20-18 Biometrics appointment. (Biometrics reviewed by USCIS on 05-21-18)
08-30-18 USCIS Naturalization Interview (Notice sent 07-25-18)
