Hello Everyone!!

Brief intro...I m US citizen and my husband is on F1 visa...we filed late January 08 and are scheduled for AOS interview on June 10, 08.

I am very nervous and confused..here is the problem

I filed from Chicago from my parents place and after couple of months moved out of state. I still kept my parents address on file with the purpose of not to delay the greencard procedure. I have job in this new state and our names on car insurance and all that proof that we live together are on different address than Chicago.

The only thing I have together on Chicago's address is our bank statement and last year tax return. When I filed, I had temp. job in chicago, which I used (I-864)to file our papers but i don't have that job anymore and have a job in new state.

My questions are

Do I tell the officer that I moved out of state but using parents address as permanent address?

Which paystub should I take with me? my current job or the job I listed when i filed our papers?

Should I take my car insurance papers/utility bills from this new state? or my bank statement and tax return will be enough to provide proof?

What would be the best answer to convey an officer that why I didnt inform USCIS about my moving?

PLEASE PLEASE HELP.

Also, if someone can guide me with what kind of questions they ask during interview, I would really appreciate.

Thank you all in advance.

Truth means as soon as we r in the office, I should tell the officer that my current paystubs and every other proof we have are from different state then what I filed with? or wait till the officer ask me what do i do?

When asked you tell the truth... If it is an issue the officer will ask... do not make it an issue by overdisclosing.... however be prepared to answer truthfully if it comes up.

This advice is the same whether dealing with the USCIS, IRS, SEC, CBP, etc... Only answer the questions that are asked, nothing more nothing less.

YMMV

If you sponsored your husband on a I-864, you needed to file Form I-865 to notify the USCIS within 30 days of your move (see I-864 instructions on that). Your husband needed to file form A-11 within 10 days of his move. Officially, both omissions carry fines from the USCIS. However, I don't know if anyone had any serious consequences because of this, you'd have to research it yourself.

Sorry for bringing bad news. All you can do now is hope that you get an understanding officer at the interview who will not decide to pursue this.

My husband and I just signed an apartment rental agreement in the new state I moved to. Do you think I should take the copy with me even though it is different than our Chicago's address?

Is it ok to say that i am using my parents address as my primary address because of security reason?

Thank you for your help

That's really not that big of an issue.

Like everyone says tell the truth when ask and don't disclose too much if it's unnecessary. Simply put you moved recently and this is your evidence, that should suffice unless they'd like more information.

Bring every piece of evidence you could muster up. If you decide not to use it for some reason that's fine but don't make the mistake of regretting to bring something.

Their primary concern isn't that you moved without informing them, it's that you prove your marriage is bona fide. They won't deny you simply because you moved.

Hey Blackie - what you need to provide is proof of co-mingled life - it doesn't matter whether the proof is from Chicago and another place - the moving to another state for jobs is extremely normal here, so do not worry about it - its not a matter of concern. Your choice to keep your parents address is perfectly OK, many people have done this - once you have a permanent place of residence you can file the change of addresses - no need to be paranoid like one of the posters. Good Luck

Here's what the IO asked on mine,

Do you have both original birth certificates? Yes

Do you have your latest income tax? Yes

Have you ever had a laser visa(tourist visa)? No Can I see your latest visa? Yes

(To my wife) you are bilingual right? Yes

(To my wife) You are getting the allergies huh? Yes <----- Seriously!

To me:

All the questions you had to answer with a "NO" on the forms, concerning: Polygamia, illegal immigration, prostitution, genocide, communism etc etc etc around 15 of them, more or less.

Others has been asked more questions like; birthdays, in-laws' info, financial, intimate details, residence, etc etc but not us. Our interview was over within 10 min and approved on the spot ;)

The IRS? Really?

We intended to move and didn't want to deal with changing addresses, so we used my daughter's address as an "in care of" address. Since at the interview, we hadn't actually moved but intended to within a few months (next month) we decided to leave the address the same for the green card mailing. The officer made a note to the file regarding our physical address.

Just explain when it comes up. Whatever you decide about an address going forward from the interview can be addressed with the adjudicator. Take everything with you and relax.

Facts are cheap...knowing how to use them is precious...
Understanding the big picture is priceless. Anonymous

Hello,

We had our interview yesterday. It did not go well :(

IO had problem with why we haven't informed them about our move? In first two min. she refuesed to interview us and said that she'll send our file to our new state but we made her understand that we live in Chicago and use parents address as primary address and our move is just temp. base.

She went out with her assistant, came back in 2 min. and asked us where would we like to get our green card? New address our parents address. We said parents address and again she went in detail and asked lot of questions to my husband (those yes and no questions) which he answered correctly.

Then she asked us if we had big wedding ceremony? We said no due to our financial situation we had small ceremony. We brought two photo albums but she did not want to see any pictures.

At end, she said we'll notify you the stauts of your application via mail. I asked her how long it will take, and she said within a month..

We did not pass :(

My questions are to all of you...

Do you guys think she'll deny whole file/AOS application? She'll cancel my husband's EAD? What will happen? What should we expect now?

As soon as we came out, we decided to change our address but I guess we have to wait till what she sends us in the mail?

Do you guys think my husband will be able to get GC ever?

Please advise.

How do you know you didn't pass? The interview was yesterday.

I think you can have an appeal and do it over again, you most likely won't have to start all over.
