Hi all in K-1 land. I have a question and I am hoping that someone here can give me facts, not just opinions. This will require some background knowledge, so bear with me.

My husbands sister was married to a Moroccan many years ago. They have a daughter together. They ended up divorced about 19 years ago and he came to the US. He married an american after he got here and she married and Egyptian man and moved to Dubai. He was married many years, had 3 kids then divorced. She was also married several years and had a son with the other man.

Well about 2 years ago when I was in Morocco, my husbands sister was also there. While there her husband (in Dubai) had a heart attack and died.

Fast forward to now. His sister and her ex husband have now rekindled their romance and want to remarry. I understand that for a fiance visa it is required to have met within the last 2 years, but he has been unable to fly out there. They are hoping that since their situation is unique, and they were previously married, that they will bypass this requirement and go for the fiance visa. I am extremely nervous about this, and I am worried that they are wasting their time and money.

So my question is, does anyone know of any situations similar? And how did it turn out?

I am really hoping they get together soon, there is so much love between them to this day.

The petitioner and beneficiary in a K1 case must have physically been together in the same place at least once within the two years preceding filing the I-129F petition. The rare exceptions are where religious or cultural issues prevent them from doing so.

Those are the facts. My opinion is any petition would be denied. There are no refunds.

Facts are cheap...knowing how to use them is precious...

It's highly doubtful that they will be given an exception to the 2 year rule. It's usually only for severe medical/religious reasons that prevent couples from meeting one another in person.

In this situation, if they filed, they would more than likely be denied and told that they need to meet in person.

If he can get on a plane and see her, I suggest he does it before they file.

The first question is whether or not this Moroccan male ever naturalized, thereby making him eligible to file a fiance visa for anyone.

Good question. Yes, he is a citizen, and has been for many years, so he is eligible.

Thanks all for your replies. You have pretty much confirmed my suspicions. He is stubborn and thinks that the immigration laws are easy like they were when he came. I hope he will listen to me. I think he is wasting his time and money on this, but he thinks he can do it since he called the call center and they thought it would be okay. It's a freaking call center and they know nothing other than basic petitions, I would never listen to that advice.

man i hope i dont get shot on this forum for this question but here goes.......they have a child together but have not seen each other for over two years???????? does he ever see or visit his child??? i have a reason for asking but lets leave that until later

I forgot my shotgun, so you are safe today...lol

The child is now over 20 years old, and is here in the US. She came over about 4 years ago and he finished raising her. She is now married and has a 10 month old baby.

:rofl: :rofl: thanks for forgetting the shot gun lol the reason i ask is because if they have a child together they can show on going visits in person for many years if they shared the child or he had regular visits.........yes there is a hard time getting permission with in two years not seeing each other........but if there is a long history of visits because of the child they could try and it might work but it would really be better if they have at least one visit before filing :)

Why complicate things???

That would be the simpler solution.

However, if they have a few hundred bucks and few months waiting time they don't mind gambling, they could give it a go. Petitioners who can prove they already know each other have a better chance bypassing the meeting requirement than others and there's the slim anecdotal evidence to prove it.

But it's a slim slim chance. Like .1 percent. Literally.

I think you are thinking the same thing I was. She should petition her. That was my advice at first, but since her citizenship is screwed up I don't know how long it will take.

I have just written to our senators office about this. I really hope she will contact the USCIS and get the real facts, and can discuss this with him, so I don't have to look like the heavy.

That was what I was thinking. Well he can try the K1 and if it fails then the daughter may have her citizenship by then.
