I am sure this question has been asked before so I tried to find the right answer but I can't. Is k1 immigrant or non immigrant visa? The customs website says its a immigrant visa, here is the link http://www.cbp.gov/xp/cgov/travel/id_visa/...sa_adrecord.xml

and the U.S department of state says its a non immigrant visa, here is the link http://travel.state.gov/visa/immigrants/ty...types_1315.html

So who is right? Upon my arrival I have to fill out I-94 so should I say immigrant or non immigrant? I am a little confused. So all k1 filers.....is k1 immigrant or non immigrant visa? Thanks.

Non immigrant.

Don't just open your mouth and prove yourself a fool....put it in writing.

It gets harder the more you know. Because the more you find out, the uglier everything seems.

It appears the answer is clear.

K1 is clearly a non-immigrant visa but that's not the whole story. Because K1 has a path to immigration, they are processed at Consulates by the immigrant visa unit and dealt with at the POE as if the visa holder is immigrating.

You pay the non-immigrant visa fee and enter without permanent resident status.

Immigrant visa holders pay the immigrant visa fee and enter with permanent resident status.

Exactly. I know at the US Embassy in Costa Rica, the K1 is treated as an immigrant visa (meaning you stand in those lines, take Immigrant Visa seeking numbers, and talk to the Immigrant Visa folks).

Seems its not quite as cut and dry as one should think.

K1 TIMELINE:

01-24-2008 = Sent I-129F to CSC

01-29-2008 = NOA1 Issued

05-28-2008 = NOA2 (125 days after NOA1)

06-02-2008 = NOA2 Hardcopy received; NVC received petition

06-04-2008 = NVC sent package to Costa Rica

06-10-2008 = Embassy received

06-13-2008 = Picked up Packet 3

06-25-2008 = Interview (28 days after NOA2)

07-05-2008 = Home to the U.S. together!

09-20-2008 = Wedding!

AOS/EAD/AP TIMELINE:

10-15-2008 = Sent giant packet to Lockbox

10-22-2008 = NOA1's Issued

11-04-2008 = RFE on AOS only: need birth certificate, ORIGINAL was taken at interview. GRRR

11-24-2008 = Biometrics

12-22-2008 = Mailed RFE packet back

01-02-2009 = AOS processing resumed

01-16-2009 = Service Request filed for EAD (90 days with no news)

01-27-2009 = EAD and AP approved (102 days after NOA1's)

03-12-2009 = AOS Interview, APPROVED!

REMOVING CONDITIONS TIMELINE:

02-18-2011 = Sent packet to CSC

02-22-2011 = NOA1 Issued

03-21-2011 = Biometrics

04-26-2011 = APPROVED!

DONE WITH USCIS FOR 10 YEARS!!

Thanks for clearing it up team. Non immigrant it is! so if any one calls me a dang immigrant they are going to get it :)

You are an immigrant...lol

K1 is a non-immigrant visa with the immigration intent

you eneter as a non-immigrant but at the same time you have to comply with some requirements for immigrant visas (medical, POE) becasue you will eventually become an immigrant after your AOS...

si i would say it is somewhere in between...

I129-F sent: 03-17-2008

NOA1: 03-24-2008

NOA2: 06-04-2008

Interview: 07-10-2008 - APPROVED!!!

Going back home: 07-23-2008 yaaaaay

Court house wedding: 10-09-2008

AOS sent: 10-16-2008

NOA1 for AOS, EAD and AP: 10-22-2008

Case transfered to CSC: 11-07-2008

Biometrics: 11-12-2008

EAD an AP approved: 12-23-2008

AOS approved: 2-27-09
