Timeline

I want to start by thanking everyone for their response to my original "drivers license" topic post....

I failed to mention in my previous topic that I live in the state of Texas (near Austin) and after contacting a local dDMV they told my wife and I that she would need an I-94 issued for over a year.

Her I-94 is currently expired. Is there something we can do in order to some how get an I-94 extension???

Has anyone else in that state of Texas had this problem? and if so what where you able to do to help your situation?

According to the Texas DMV Website an I-94 issued for greater than one year is only applicable to a J-1 or J-2 visa. A K-1 visa holder will never receive an I-94 that goes beyond the 3-month (K-1 entry) or one year (AP doc) timeframe. She will need to present her EAD or greencard in order to get a license. (Again, according to their website.)

In Dallas, I got the same problem when I went to ask for my driver license when I only had my K1 visa. I was able to apply for the driver license until I had my EAD (employment authorization). In fact, I went this morning to do the driver test and I passed!! Good luck you too.

i was able to get a TX license with an expired I-94..

but I had a valid Maryland License, so I fit their requirments.. I think if you have a valid passport, SSN and ead you should be able to get one..

THey told me the same in Louisiana. I showed them what the website said and insisted on them checking again. They got pissed and made me go home again and get my marriage certificate and the NOA for my AOS, for what reason I don't know, but- I got my drivers license...lol

So yeah, if you have a passport, SSN and EAD or greencard, you should be okay.

Oh my...I am here in the same situation....and I was already studying the driver's book before the I-94 expired, but I was so consumed in getting the AOS stuff ready to mail....that I totally ignore it. I got my SSN when the I-94 was still valid....it should work, but....I don't know. I'm also in DFW area. The EAD is in process, hopefully I'll get it soon.

Any other advice?

not sure.. I was only able to get it because I had a an out of state license..

I think you will have to wait for the EAD.
