Expedite for USC serious Medical condition

Timeline

Seeking some advice and recommendation where the K-1 is submitted, and the USC is advised a serious medical condition exists; (the Stage 4 kind) and a fair prognosis but not a likely a cure. What is the best way to be joined with fiancee soonest.

NOA2 issued April 2008

Interview July 22, 2008 APPROVED

Arrived USA. POE SFO July 31, 2008

Married September 5, 2008

Filed AOS, EAD, AP September 17, 2008

EAD and AP approved 12/2/2008

AOS approved 02/09/09

You need to call USCIS to their number

talk with the customer service representative, then you ask for expedite

they will tell you that only a matter is medical or National Security matter!

Other reason wont be accepted!

They will ask you what is the problem and you have to explain.

If they see its a valid reason then they will create a service request

be ready with a pencil to write down the number, and wait for 2 to 3 days

to receive an email confiming that they received the request, and they will

ask you for a letter from you detailing your situation and any other documentation.

They will give you other details to where submit those documents.

If they approve the Expedite then you have a 99% chance to get approved

in a couple of days. That all depends on your situation.

I asked for an expedite when I lost my unborn child and had to have surgery alone. I have no family here where I live as I am here doing my doctoral studies. The USCIS told me that I cannot need my husband (the beneficiary). She said by petitioning for him to come, I am saying that I will take care of him in every way, not just financially. I am not allowed to need him at all. This is what I was told and I was denied an expedite, despite a letter and tons of documentation. My congress person's office said matters of national security only. I have seen others get a medical expedite....good luck!

Just trying to muster the energy (and the money) to do this again.

I made the telephone request for the expedite on April 1. Recieved an email requesting more documentation on April 3. Faxed papers to CSC on April 9. Follow up call on April 15 without much feedback. Faxed same papers again on April 16. Recieved email with approval of I-129F on April 22.

I am super happy and cant wait for my dear to wake up so I can tell her.

Congrats on the expedite!!! They are so difficult to get so its great to hear you can be together that much sooner. Here's to a wonderful life together!

This is great news. Even though it pains me to bring it up, there is also somthing else about which you should be aware. If your fiance comes here on a K1 visa, you must marry and complete the AOS process (I wonder if that can be expedited in your case.) while you are living. If not, she cannot complete it on her own unless you are married two years before passing.

Hopefully, all this means is you expedite all elements of her immigration process through receipt of the conditional green card.

Facts are cheap...knowing how to use them is precious...

i got expedite because i had to take care of 4 children. CSC gave expedite but NVC didn't. good luck. it all depends who is looking at your request.

Interview went well and medical good. She left Kuala Lumpur on 7/25 to Brunei to resign her job and pack. She departed July 30 from BWN and will arrive CAK late on the 31st. So happy. :dance::dance::dance::energy:(L)
