Hi,

I understand that this topic has been possibly discussed in the past but I would like to see if anyone can shine anymore insight on it.

I'm wondering if USCIS will honor a quick divorce, a divorce done in a few days in Dominican Republic, Guam or even Nevada. I'm looking to marry my fiancee from Russia asap, but the issue is that i'm still married, even though we've been separated.

As long as you are legally divorced, AND free to marry your fiance, you will not have any problems. You cannot apply for the K-1 Visa before you are legally divorced.

A legal divorce is a legal divorce regardless if it was quick, long, contested, uncontested, painless, painful, cheap or expensive.

However, most U.S. states will not recognize the typical Dominican divorce whereby one party signs a power of attorney while the other party travels to the Dominican Republic, makes a personal appearance in court and receives a divorce decree on the spot or by mail a week or so later.

I've been in the exact same situation. Decided to file in Massachusetts and wait out the nisi period. I'll have my decree in a little more than 2 weeks. ;)

It's important to understand that most of these places now have pretty strict residency requirements (such as nevada, which is not like it was a few years back ;) ) or stay for a minimum amount of time before you can file so you're best to do your homework. In recent years many of the laws have changed so don't go by old web info or hearsay. ;)

Another thing to consider is the consulate's view on your 'quicky' divorce. It shouldn't be a problem as long as you are legally divorced but I would imagine there would be more scrutiny especially at certain consulates.

I know it's frustrating. I've been living it for years!

Then in the eyes of the US Government it is NOT a legal divorce....

It's a legal divorce where it was issued. Whether it is recognized is a state issue and is not a decision of the U.S. government. Some states may choose to recognize it while others do not.

MA has a document called "decree absolute". You must have that in hand to file with any fiance petition. I've read a couple sad stories of MA residents thinking they were divorced when they weren't yet.

A legal divorce in the "State" of NV or the US Territory of Guam are legal for immigration purposes but I would never say "you won't have any problems". Quicky divorces don't cause denials on the grounds of not being divorced but they can bring extra scrutiny to the relationship bona fides, particularly in high fraud countries.

Oh believe me, I know! You were one of the ones that responded to my first post way back in September before I could even get my ex into court. ;) We are still on good terms but he really dragged his feet when it came to the divorce....we're talking years! I actually had an appointment with a lawyer already set up the week after Russell was denied entry and sent back to NZ. We went to court on December 14th and we are currently in the nisi (waiting) period (30 + 120 days = 4 months). My divorce will be 'final' on April 14th and i've already contacted the registrar of deeds in my county to have my decree absolute ready on the 15th! ;)

Thank you for taking the time to post that. It's important people know!
